A special meeting of the Jewett Town Board was held on Thursday October 26, 2017.
Supervisor Pellitteri called the meeting to order at 6:02 P.M. Present were Board Members
Michael McCrary, William Trach and Nathan Miles. Councilwoman Constable was absent.
Also present was the town clerk.
On a motion by Councilman McCrary, seconded by Councilman Miles and carried, the Board opened the public hearing for Local Law #1 of 2017 entitled, “A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW §3-C”at 6:02 P.M.
There was no public present. The board discussed the proposed law as well as the preliminary budget.
On a motion by Councilman McCrary, 2nd by Councilman Miles and carried, the board moved to close the public hearing for the proposed Tax Cap Override Law at 6:16 pm.
On a motion by Councilman McCrary, 2nd by Councilman Miles and carried, Local Law #1 of 2017 was adopted. This law is entitled, “A LOCAL LAW TO OVERRIDE THE TAX LEVY LIMIT ESTABLISHED IN GENERAL MUNICIPAL LAW §3-C”
Be it enacted by the Town Board of the Town of Jewett as follows:
“Section 1. Legislative Intent: It is the intent of this local law to override the limit on the amount of real property taxes that may be levied by the Town of Jewett pursuant to General Municipal Law §3-c, and to allow the Town of Jewett to adopt a budget for the fiscal year beginning January 1, 2018 and ending December 31, 2018 that requires a real property tax levy in excess of the “tax levy limit “as defined by General Municipal Law §3-c.
Section 2. Authority: This local law is adopted pursuant to subdivision 5 of General Municipal Law §3-c, which expressly authorizes the Town board to override the tax levy limit by the adoption of a local law approved by vote of at least sixty percent (60%) of the Town Board.
Section 3. Tax Levy Limit Override: The Town Board of the Town of Jewett, County of Greene is hereby authorized to adopt a budget for the fiscal year 2018 that requires a real property tax levy in excess of the amount otherwise prescribed in General Municipal Law §3-c.
Section 4. Severability: If any clause, sentence, paragraph, subdivision, or part of this local law or the application thereof to any person, firm or corporation, or circumstance, shall be adjusted by any court of competent jurisdiction to be invalid or unconstitutional, such order or judgment shall not affect, impair, or invalidate the remainder thereof, but shall be confined in its operation to the clause, sentence, paragraph, subdivision, or part of this local law or in its application to the person, individual, firm or corporation or circumstance, directly involved in the controversy in which such judgment or order shall be rendered.
Section 5 Effective date: This local law shall take effect immediately upon filing with the Secretary of State.”
ROLL CALL VOTE: AYE Pellitteri, Miles, McCrary and Trach. Absent was Councilwoman Constable.
On a motion by Councilman McCrary, seconded by Councilman Trach and carried, the Board opened the public hearing for the preliminary budget at 6:18 P.M.
There was no public present.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried, the board moved to close the public hearing for the preliminary budget at 6:19 pm.
Voting to adopt the Preliminary Budget for 2018.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried The Board adopted Resolution #14 of 2017. SUBJECT: Adoption of the 2018 Preliminary Budget.
“WHEREAS, the motion to override has been duly passed,
THEREFORE BE IT RESOLVED, The Town of Jewett Board moves to adopt the preliminary budget for 2018 as the final budget.”

Councilman McCrary made a motion, 2nd by Councilman Miles and carried the board regretfully accepted the resignation letter of Donna Bernard as Chair of The Planning Board with many thanks, effective January 1, 2018.
Councilman McCrary made a motion, 2nd by Councilman Miles and carried to appoint Gregory Kroyer who is currently the vice chair, as the new chair of the Planning Board effective January 1, 2018.
Councilman McCrary made a motion, 2nd by Councilman Miles and carried the board entered into executive session at 6:24 pm for the reason of “The medical, financial, credit or employment history of a particular person or corporation, or matters leading to the appointment, employment, promotion, demotion, discipline, suspension, dismissal or removal of a particular person or corporation.”
Councilman McCrary made a motion, 2nd by Councilman Trach and carried the board came out of executive session at 6:35 pm. No action was taken.

The general meeting of the Jewett Town Board was held on Wednesday October 11, 2017. Deputy Supervisor McCrary called the meeting to order at 7:06 P.M. Present were Board members William Trach, Nathan Miles and Allyson Constable. Supervisor Pellitteri was absent.
Public present was Carol Muth, Don Muth and Tim Osborn, of the East Jewett Fire Department. Also present was Tal Rappleyea, Esq. and the Town Clerk.
The Supervisor’s financial report was given to the Board prior to the meeting and the bank statements were reviewed by Board Members after the signing of the bills.
Councilwoman Constable made a motion, 2nd by Councilman Miles and carried the board moved to accept the minutes from September 13, 2017.
Highway Superintendents Report: Chips money has arrived and we have received a check for $109,000.00. The highway department has been preparing for the winter; with painting and sandblasting almost finished on all town vehicles. The summer maintenance of Maplewood Cemetery has been completed and all equipment stored for the season.
On a motion by Councilman Miles, 2nd by Councilwoman Constable and carried The Board moved to accept the Code Enforcement Officers report.
Deputy Supervisor McCrary and the Board discussed and reviewed the tentative budget.
On a motion by Councilman Trach, 2nd by Councilwoman Constable and carried The Board moved to accept the tentative budget as the preliminary budget.
On a motion by Councilwoman Constable, 2nd by Councilman Miles and carried, The Board moved to set two public hearings for Thursday October 26, 2017 at 6pm in the Jewett Town Hall located at 2547 Route 23C in Jewett. The first public hearing will be for the preliminary budget and the second public hearing is regarding Local Law #1 of 2017 entitled, “To Override the Tax Levy Limit Established in General Municipal Law §3-C”.
On a motion by Councilman Miles, 2nd by Councilwoman Constable, The Board adopted Resolution #13, SUBJECT: AUTHORIZING THE JEWETT TOWN JUSTICE COURT TO APPLY FOR A JCAP GRANT.
“WHEREAS, The town of Jewett wishes to ensure the highest level of service and professionalism and,
WHERAS, The Town continues to search for and secure funding Assistance for the Town Court; and,
WHERAS, The Town Justice has identified a funding opportunity thru the application of The Justice Court Assistance Program (JCAP),
NOW THEREFORE BE IT RESOLVED, that the Town Board of Jewett hereby supports and approves The Town Justice’s application for a grant request to the New York State Unified Court System Justice Assistance Program; and be it further
RESOLVED, The Town Board of Jewett authorizes the applicant to request up to the maximum amount available.”

The Board discussed updating The Cold War and Alternative Veterans maximum exemption amounts.
On a motion by Councilman Trach, 2nd by Councilwoman Constable and carried, The board moved to request Tal Rappleyea, Esq. update the law to the maximum exemption amounts and add the words, “in perpetuity” to the law therein, with the public hearing scheduled before the end of the year.
The East Jewett Fire Department requested an audience with the Jewett Town Board to relate a very serious situation they have encountered regarding solar panels. Don Muth, president of The East Jewett Fire House took the floor and began to explain solar collectors. Solar collectors or solar panels have come a long way since when they were first made. Ones being manufactured today are much stronger in pulling electricity from light sources as well as holding the electricity it collects. These systems produce so much electricity; 600 volts dc American, 1000 volts dc in European models that the systems cannot be shut off manually. Firefighters have tried to throw black plastic tarps over the units, but they still produce too much energy. When Firefighters arrive on the scene of a burning building, the first action is to have all power disconnected by the utility companies. When trying to put a fire out that has solar panels, it has been found that because the volts are so high, the electricity will travel thru the water as a conduit and go back to the firefighter that is holding the hose. Many firefighters have died and many fire companies are refusing to put their people in this line of danger. This situation is not just limited to our area, but is a worldwide fire issue. Timothy Osborn, Fire Chief of The East Jewett Fire Company is requesting that the town give them a list of all homes that have any type of solar power units, so that the fire company can contact them and go over their units with them.
The board agreed to have the Code Enforcement Officer, together with his assistant go thru records of building permits given for solar panels and present the list to the Fire Chief of
The East Jewett Fire Company.
Discussion came up regarding the housekeeping of the senior center in the town hall.
A situation arose late one night as Judge Canfield was coming in to do an arraignment and could not get into the court room because of “stuff” being improperly stored near the entrance.
Attorney Tal Rappleyea will review our contract with the county and reach out to the appropriate person to remedy this issue.
Councilman Miles made a motion, 2nd by Councilman Trach and carried to authorize the Supervisor to negotiate with The Greene County Sherriff’s department regarding a formal agreement to be made for occupying, leasing or paying for space within the Town Hall of Jewett to be used as a sub office for issuance of gun licenses.
Councilman Trach made a motion, 2nd by Councilwoman Constable and carried to approve the bills. General Fund was $6,745.69 on abstract #10, claim numbers 196-212. The Highway Fund was $21,722.42 on abstract #10, claim numbers 145-167.

Highway Superintendents Report: Continuing to ditch roads and clean out culverts. Superintendent Mallory went to a third FEMA meeting this past week, regarding two programs, STELLA and PAVE NY. We have been given approval for the reimbursements; all final paperwork has been given and signed.

On a motion by Councilman McCrary, 2nd by Councilwoman Constable, The Board adopted Resolution #10, SUBJECT: NYC-FUNDED FLOOD BUY OUT PROPERTY OF BARBARA ROSENTRETER IN THE TOWN OF JEWETT.
“WHEREAS, The Town of Jewett has granted DEP ownership of the buyout parcels, specifically the Barbara Rosentreter property, and
WHEREAS, The Town of Jewett has no interest in taking title of the property owned by Barbara Rosentreter, and
WHEREAS, If the City elects to acquire the property referenced above, this property will be managed by the NYC DEP as open space. Minimal management of the property will be performed by DEP which will include activities such as inspecting the property annually, maintaining the boundary lines and posting signs. Should the Town at some point in the future want the property actively managed (i.e. mowed, snow plowed, construct and maintain permissible recreational facilities), the City will consider issuing the Town a revocable land use permit to address these activities or any other maintenance requested by the Town.
THEREFORE BE IT RESOLVED, The Town of Jewett Board moves to grant DEP title of the property of Barbara Rosentreter.”

WHEREAS, The Town of Jewett has been asked to vote for 2, two year candidates as regular members to serve on the executive committee AND 2, two year candidates to serve as alternate members of the executive committee,
THEREFORE BE IT RESOLVED, the Town of Jewett board moves to nominate for the Executive Committee of Watershed Towns, two (2) regular members, the first being Councilman McCrary from the Town of Jewett and the second being Councilman Anthony Coiro from the Town of Hunter; And two (2) alternate members the first being Councilman Donald Murray of the Town of Windham and the second being Councilman David Kukle from the Town of Hunter, with the request being made to the Town Clerk of Jewett to follow the instructions to send nominations in to Young and Sommers, Attorneys at law”.

Councilman McCrary made a motion, 2nd by Councilman Miles and carried to authorize Supervisor Pellitteri to sign a letter regarding mountain biking on DOH land, submitting the Town of Jewett’s comments for the 2017 draft filtration avoidance determination (FAD) period to include the preservation of hiking trails and the consideration of hunters that have already been using DOH land.

Highway Superintendents Report: Superintendent Mallory has been given approval for the Town of Jewett’s reimbursements regarding STELLA and PAVE NY. FEMA will be meeting with the town in September to complete all final paperwork.
Discussion regarding town space needs continued with the topic geared towards the septic system.

The Board requested that the ZEO, Stacy Sprague, begin to send in monthly reports of inspections that were done by her department.
Shared Services: Supervisor Pellitteri went to the most recent shared services meeting and discussions were towards possible insurance consolidation and shared IT services within the county.
Councilman McCrary shared information regarding The Margaretville Telephone Company.
A map was given out to board members showing all the areas of Lexington and Jewett where they are planning to have “hook ups” for service.

The general meeting of the Jewett Town Board was held on Wednesday July 12, 2017.
Supervisor Pellitteri called the meeting to order at 7:02 P.M. Present were Board Members

The Supervisor’s financial report was given to the Board prior to the meeting and the bank statements were reviewed by Board Members after the signing of the bills.
Councilman McCrary made a motion, 2nd by Councilman Trach and carried the board moved to accept the minutes from June 6, 2017.
Highway Superintendents Report: The highway crew has been working on ditching roads and grading. Also, some minor truck repairs have been done. Working on Mallory and Pangman Road, repairing any drainage issues there. Hunter Environmental was here and pumped out both septic tanks. Superintendent Mallory sent in all paperwork to FEMA regarding two programs, Harsh Winter and Pave NY. We are expecting to receive about $109,000.00 from the programs.
Discussion was continued regarding town space needs and different protocols that may need to be put into place to optimize the smoothest flow at the town hall.
Councilman Trach had asked about 82 Tower Mountain Road in Jewett and if any update was available from the code enforcement officer. None was given.
On a motion by Councilman McCrary, 2nd by Councilman Miles and carried The Board moved to accept the Code Enforcement Officers report. Councilman Trach voted Nay.
On a motion by Councilman McCrary, 2nd by Councilman Miles and carried, the board adopted Resolution #9 of 2017. Subject: Resolution in Support of Extending the Comment Period for the 2017 Town Level Assessments for the LAP
WHEREAS: The Town of Jewett is located within the Schoharie Watershed basin in the northern Catskill Mountains, has land wholly or partially within the NYC Watershed and the Catskill Park where parcels owned by NYC and NYS are protected from future development, respectively; and
WHEREAS: The Town of Jewett reviewed the 2017 Town Level Assessments report developed by NYCDEP to evaluate the effect of the Land Acquisition Program (LAP) on the supply of land available for future development in each town; and
WHEREAS: the LAP is one of the core watershed protection programs in the Memorandum of Agreement and may be a long term program, it should be analyzed in a way that reflects the long term impacts from such a program on local communities’ economic viability; and
WHEREAS: the methodology the NYCDEP used in the Town Level Assessments on one level was thorough, it lacked detailed criteria and incorporated assumptions due to an aggregating approach that presents potentially skewed conclusions as to the amount of developable land that would be available in 2025 and beyond; and
WHEREAS: the Coalition of Watershed Towns requested a three month extension to October 31, 2017 to allow additional time for comments and for an independent review of the NYCDEP’s Assessments that would include additional parameters, such as zoning, subdivision and deed restrictions, in order to provide more detail on remaining developable land in 2025 and beyond; and
WHEREAS: the Town of Jewett supports an independent review of its town assessment and will work with Greene County SWCD and the Catskill Watershed Corporation (CWC), which is hiring a consultant to go into greater detail to refine the NYCDEP conclusions;
NOW THEREFORE BE IT RESOLVED: The Town of Jewett supports the CWT’s request for a three month extension and is requesting that be honored by NYCDEP and participating state agencies.

Shared Services: Councilman McCrary went to the second Greene County shared services meeting. There were only about 5 people who showed up and the meeting was cancelled.
Other Business: Councilman McCrary read an e-mail correspondence from Margaretville Telephone Company regarding progress that was made on Route 17, the company is still waiting for a list of interested residents on route 17.
Councilman Trach asked about an update regarding the upcoming bike race that passes thru parts of the town of Jewett in August. Councilman McCrary informed him that he has not heard from Dieter Drake and that he would reach out to him before the next general meeting. A resolution of support will not be given from the town unless all emergency and safety protocols are in place.

Supervisor Pellitteri called the meeting to order at 7:04 P.M. Present were Board Members

Councilman Miles made a motion, 2nd by Councilman Trach and carried the board moved to accept the minutes from May 10, 2017.
Highway Superintendents Report: Bids were advertised for the 2017 highway black top paving project for the Town of Jewett. Bids were opened May 15, 2017 at 2:05pm. The following sealed bids were received:
Cobleskill – $59.70
Peckham – $62.08
Callanan – $57.47
Superintendent Mallory accepted the bid from Callanan as they were the lowest bidder.
Bids were advertised for a surplus loader. Bids were opened May 15, 2017 at 2:10pm.

Lisa Hommell – $100.00
Superintendent Mallory accepted the bid from Ms. Hommell as hers was the lowest and only bidder.
The highway blacktop paving project was completed on five (5) roads: Merwin St., Cloos Rd., Koss Rd., Rice St. and Boy Scout Rd. Funding for this project was provided by FEMA in the amount of $109,000.00, PAVE NY in the amount of $17,667.73 and EWR (Emergency Winter Recovery) in the amount of $14,019.48.
Councilman McCrary made a motion, 2nd by Councilman Miles and carried, the board moved to request Supervisor Pellitteri write a letter to CIA Alarm Company giving permission to the company to call the alarm contact person instead of the police during normal business hours,
7am-3pm. All ayes.
About a month ago, as the highway crew was maintaining the Maplewood Cemetery, they came across a grave site with a dead tree. The highway crew took it out to keep the appearance of the cemetery groomed. Unfortunately the person who maintains that particular grave site was offended by the innocent action of the highway department and left a sign with words that were threatening.
Councilman McCrary made a motion, 2nd by Councilman Miles and carried, the board moved,
“WHEREAS, the safety of the Jewett Highway employees is of great importance to the Jewett Town Board, and
WHEREAS, the general appearance of the Cemeteries for which we have taken responsibility is also of importance to the Town Board, and
WHEREAS, an unattributed seeming threat has been received,
THEREFORE, be it resolved to place a sign at the entrance to Maplewood Cemetery reading:
“To Those Who Care for the Burial Sites Contained in the Cemetery:

Discussions were continued regarding the towns building space needs. As the town is required by NYS to keep certain records, it is estimated that we will need about 3,600 square feet of space as the Town of Jewett continues to grow. Questions were asked if the town building should stay in the current sport or move to a new location where it will have the space to grow.
The board reviewed the code enforcement officer’s report. Councilman Trach had questioned why a particular property, 82 Tower Mountain Rd. that did not have a building permit for their roof that he had specifically asked the CEO to check on last month was not in the report, nor did the CEO follow up with Councilman Trach regarding it.
On a motion by Councilman McCrary, 2nd by Councilman Miles and carried The Board moved to accept the Code Enforcement Officers report. Councilman Trach voted Nay.
Councilman McCrary made a motion, 2nd by Councilman Trach and carried the board moved to amend the fee structure of the building department to include a penalty for non closure of a building permit to be not more than the original building permit fee. All ayes.
Councilman McCrary made a motion, 2nd by Councilman Miles and carried the board entered into executive session at 7:45 pm for the reason of “The medical, financial, credit or employment history of a particular person or corporation, or matters leading to the appointment, employment, promotion, demotion, discipline, suspension, dismissal or removal of a particular person or corporation.”

Councilman McCrary made a motion, 2nd by Councilman Miles and carried the board moved to recommend that the Code Enforcement Officer join NYSBAC (New York State Buildings and Codes) as soon as possible.
Supervisor Pellitteri informed the board of a program that was implemented this April by the governor in the budget for NYS. This is called Shared Services. The governor is encouraging all towns and counties to come up with different plans to merge services. This would mean that some departments or jobs would be dissolved so that less people can do the same job and any money that the town saves in the first year will be matched by the governor. All ideas must be new and save money. The track that Greene County seems to be taking is possibly consolidating health care for the whole county. Another idea was sharing one code enforcement officer for multiple towns amongst other ideas. The deadline is August for everyone, both the town and county to agree, which will be very difficult given the time frame. Councilman McCrary has spoken to various people who have experienced this type of consolidation. He said, “You need to figure on a minimum of 3 years, closer to 5 actually to put it all together and wait for contracts to expire. While everyone is seeing that this is a good idea in general, it certainly won’t come under the present plan or the extension of the plan into next year. There would be no way to predict that you would see any real savings for 5 or 6 years. Not even in the first few years of implementing it because you have to put the money up first and it will be a big bullet to bite. But, I do think that that is one of two projects that make any sense; the other one being county wide record keeping.
Tal Rappleyea, esquire said they are also thinking about consolidating tax collectors.
Maya Carl, tax collector for the Town of Jewett took the floor and related her feelings on the matter. She said, “In the end it won’t save any money. You get rid of all the tax collectors; you then have one person at the county level. There is no way one person can collect taxes from all 14 towns. One person for one town is a big job. So now that person who is collecting at the county level will probably hire clerks and now you are getting almost into the same amount of payroll if you would have just left everyone alone. And also residents, if they have any business for taxes will have to go down to the county, they are saying you can go to the local banks to pay your taxes but if you need to speak with someone, if you need to work something out you will have to drive down to the county. I guarantee they will not personalize their service to the person. If I am here, I can work with our residents, the county wont. So the towns’ people will lose any type of personal service and residents will end up spending more in gas and time to go down to the county. But, if they do recommend this then there will have to be a public referendum because I am an elected official, so then the people would have to decide. But, not for nothing, my son’s food plate will be a little less.”
Tal Rappleyea agreed and said, “A big part of it too is that residents will come in and want to update their personal information and the county is not really going to care to do this, or will not do it correctly”.
Councilman Miles said, “I am very hesitant on almost all, well there are some things that could be an advantage, but I am hesitant on most issues to take anything and step it up one branch of government. The further away you get away from the people, the less say the residents have. So once it goes to the county and then to the state, the further you get up in the branch of government the less voice of where those funds are going. So there might be an alleged savings but even if you don’t see that lack of voice initially down the road it has that potential. I am very hesitant to give away any authority from local township. And would really consider hard before giving any authority on any issue, please let us think very carefully about this”.
Councilman McCrary will be going to the next county meeting which will be taking place in Cairo on June 29th at 4pm in the 911 emergency services building. Councilman McCrary will recommend that the Greene County consolidated Health plan and record keeping ideas are ones that the Town of Jewett may possibly be open to.
Other Business: Supervisor Pellitteri informed the board that the air conditioning unit upstairs in the Senior Center has stopped working and is unfixable. Supervisor Pellitteri received the following bids for a new air conditioning unit:
Huber Enterprises – $4,900.00
Batavia Kill Plumbing and Heating – $3,800.00
Rob Drum Plumbing and Heating – $3,750.00
Supervisor Pellitteri accepted the bid from Rob Drum Plumbing and Heating as they were the lowest bidder.
Councilman McCrary made a motion, 2nd by Councilman Miles and carried the board moved to nominate for the Executive Committee of Watershed Towns, two (2) regular members, the first being Councilman McCrary from the Town of Jewett and the second being Councilman Anthony Coiro from the Town of Hunter; And two (2) alternate members the first being Councilwoman Bonita Chase of the Town of Prattsville and the second being Councilman Donald Murray of the Town of Windham, with the request being made to the Town Clerk of Jewett to follow the instructions to send nominations in to Young and Sommers, Attorneys at law. All Ayes, Councilman McCrary recused himself from the vote.
Anthem Sports has requested a resolution of support from the Town of Jewett for their upcoming event on August 5, 2017. There were many variables that need to be addressed before the town can support Anthem Sports.
Councilman McCrary made a motion, 2nd by Councilman Miles and carried the board moved to table Anthem Sports request until the next general board meeting scheduled for July 12, 2017.
Councilman Trach made a motion, 2nd by Councilman McCrary and carried, the board moved to pay $95 per child, who are residents of the Town of Jewett, toward the village of Hunter’s day camp fees, total donation from the Town of Jewett not to exceed $400.00.

Supervisor Pellitteri called the meeting to order at 7:00 P.M. Present were Board Members

Highway Superintendents Report: The town will offer residents a cleanup day. Dates are
May 30, 31st and June 1st. Advertisements along with a description of what can be picked up will be placed in the newspaper and on our website. Ads were placed in the newspaper regarding black top bids for paving, as well as an ad for bids regarding a surplus sander. The highway department received confirmation that we will be getting approximately $109,000 in grants for the paving this year from CHIPS for towns that have experienced a “harsh winter”. Another fund, PAVE NY has been created and we will apply for that as well. Superintendent Mallory went to a FEMA meeting in Cairo this month and applied get funded for the snow storms this past winter. NY State will make the final decision if they will declare an emergency regarding the winter storms.
Bruce Transue, of Hunter Mountain took the floor and requested that the board grant a Public Assemblies Permit for their two upcoming events, Mountain Jam and Taste of Country that will take place in June of 2017.
Councilman McCrary made a motion, 2nd by Councilwoman Constable and carried, the board moved to grant Hunter Mountain a permit for Public Assembly for Mountain Jam and Taste of Country, subject to the provision of all requested documents.

Other Business: Supervisor Pellitteri presented the board with two new polices that he would like implemented in the town hall. One was a Sexual Harassment Policy and the other was an Internet and Use Policy.
Councilman McCrary made a motion, 2nd by Councilman Trach and carried the board moved to adopt the Sexual Harassment Policy, pending changes in section 10 that the word “one” will be inserted into the sentence, “Any ONE of the presently elected Town Board Members”.

Councilman McCrary brought up an issue regarding the town’s old website, townofjewett.com. Invalid information is still being accessed thru the back door of the old website. It seems that there are some problems in shutting it completely down. The issue lies between the previous web master and the Chinese who own the servers.

During the last snow storm, one of the trucks plow fender ripped off. Insurance has been notified. Superintendent Mallory was contacted by Greene County regarding FEMA. FEMA would like a report to be put together by the town on what we think the last storm cost us. Superintendent Mallory put the report together and sent it in.
Discussions were had regarding the towns building space needs. Conversations went in the direction of possibly bidding out preliminary plans for future construction.
On a motion by Councilman McCrary, 2nd by Councilwoman Constable and carried The Board moved to accept the Code Enforcement Officers report.
The board spoke about affidavit of cost vs. square footage fees.
Other Business: Councilman McCrary brought up a question to Tal Rappleyea, Esq. regarding peddler permits and if it was necessary for Jewett to have one. On the advice of
Mr. Rappleyea, it was not necessary.
Councilman McCrary also mentioned that he was approached by a resident on CR17 regarding internet connection. He suggested that the resident reach out to fellow neighbors on CR17 and have them sign a petition to show Spectrum that there is an interest for their services on CR17.

Highway Superintendent’s Report as Follows: Continued plowing and sanding, due to last storm. One of the older trucks is at Ben Funk’s for repair, estimated repair between $8,000 – $12,000.
In the highway shop the crew is presently servicing equipment and trucks and getting the broom ready.
Clean up day was brought up and may possibly be in May this year. More details will be finalized by the next general board meeting.
Representatives of the Margaretville Telephone Company took the floor and gave an overview of their current expansion projects that would include service to “unserved” areas in Jewett. They have received a grant toward the Lexington Broadband Initiative to bring internet service to the Town of Lexington and that includes part of Jewett. Roads possibly covered would be County Route 13 and County Route 23C. They would like to work with the town to help identify areas that are adjacent to their initiative project area that they should look at while they are doing the engineering process to know what the opportunities are. Councilman McCrary right away suggested the Jewett Fire house on CR 17 and two additional businesses in the area of the fire house that would be interested in internet service. The Margaretville telephone company welcomed the suggestion and requested contact information. Councilman McCrary asked a question about franchise agreements. They answered that they would be interested in a franchise agreement with the Town of Jewett and would most likely follow suit of our current franchise agreement with Time Warner. Councilman McCrary will forward contact information to them as well as a copy of our current franchise agreement with Time Warner.
A motion was made by Councilman McCrary, 2nd by Councilman Trach and carried to accept the
East Jewett Fire Department and Rescue Report for 2016.
A motion was made by Councilman McCrary, 2nd by Councilman Miles and carried to table the Code Enforcement Officers Report subject to satisfactory comments on listing of building permits from 2017.
Other Business: Supervisor Pellitteri wanted the board to be aware of an upcoming race called Montezuma’s revenge. It will be taking place in June, with possible race coming thru some parts of the Town of Jewett.

The board had requested at the last meeting that a report be given to them from the code enforcement officer as to the status of certain open building permits. No report of explanation was provided to the board for this month’s meeting. Therefore, the Code Enforcement Officers Report was not accepted and the board requests a return report by the next monthly meeting. On another note, the board is grateful that the code enforcement officer has completed his training course.
William Mead, resident of the Town of Jewett took the floor to speak with the board regarding his client Krzysztof Hadaczek’s recent denial of a request to re-open a variance case. At the last board meeting, Mr. Mead was advised by the supervisor to get estimates of exactly how much more money his client would have to spend in order to build a garage in the area that the zoning board had suggested, instead of his original site. Mr. Mead did just that and was denied the opportunity to re-open his request for a variance.
Mr. Mead said Mr. Hadaczek, his client, has followed all the required steps of applying for the requested variance, and cannot understand why he keeps getting denied, since his request is nothing more than putting a simple garage up on his own property which his neighbors have attested that they do not have a problem with it.
Mr. Mead very much expressed his frustrations of the zoning process and questioned why a nearby property that has many junk cars out-front is not being addressed by the town, even though it is an eyesore to his client and neighbors. Mr. Mead was then told by Town Attorney Tal Rappleyea that if he would like to make a complaint, to please make a formal one to the zoning enforcement officer in writing. Mr. Mead said he would do just that and left.

Permission is given to the Supervisor to pay electric, health insurance, telephone and discounted bills when they come due. A running balance of $100.00 for the Town Clerk/Tax Collector from A1410.4 will be maintained. Permission is given to the Supervisor to enter into an Inter-Municipal Highway Agreement with Towns and Greene County. The Deputy Registrar of Vital Statistics, Cindy Mallory will be paid $50.00 per year from A4020.4. The Town Board authorizes expenditure of funds for job-related schooling.
Board meetings are the second Wednesday of each month at 7:00 P.M. in the Municipal Building. Audit by all board members will precede the regular meeting at 6:45 P.M.
Mileage reimbursement is $.45 per mile for all Town business not occurring at the Municipal Building.
Committee and liaison appointments, if any, will be made at the February meeting.

Councilman McCrary made a motion, 2nd by Councilman Miles and moved to adopt Resolution #2 of 2017. This resolution establishes wages, benefits, purchase agreements, county and/ or state contracts and paid holidays for the highway department.
BE IT RESOLVED:
WAGES be paid as follows: 1/1/2017
Mechanic/Truck driver/foreman $22.57 per hour
Highway equipment/truck driver $19.34 per hour
Truck Driver #1 $18.34 per hour
Truck Driver #2 ` $16.88 per hour
Overtime paid at 1 ½ hourly rate over 40 hours per week. Overtime paid on a holiday at 2 times the hourly rate.

5 Days Personal Leave
5 Vacation days from 0 up to 2 years service
10 Vacation days over 2 years up to 5 years of service
15 Vacation days over 5 years up to 10 years of service
20 Vacation days over 10 years of service and up

Schedule of vacation to be picked based on seniority
PURCHASE AGREEMENT:
The Superintendent of Highways shall be authorized to spend up to $1,500 per purchase without prior approval from the Town Board and have a running balance of $50 for miscellaneous expenses from DA5130.4.
COUNTY AND/OR STATE CONTRACTS:
The Superintendent of Highways shall be authorized to purchase under County and/or State Contract without competitive bidding.
PAID HOLIDAYS:
New Year’s Day, Martin Luther King, Jr. Day, President’s Day, Memorial Day, Fourth of July, Labor Day, Columbus Day, Election Day, Veteran’s Day, Thanksgiving Day and Christmas.
BENEFITS:
Highway Department crew uniforms provided on an as-needed basis.

Upon presentation of other insurance, medical Insurance buy-out will be paid quarterly at 50% of the individual premium as billed to the Town of Jewett in January.

Current Highway Department crew will receive a longevity payment equal to $100 per year for each year of service as per contract. Payment will be made on a semi-annual basis.

Councilman McCrary made a motion, 2nd by Councilwoman Constable and moved to adopt Resolution #6 of 2017. SUBJECT: ADOPTING THE GREENE COUNTY SUGGESTED SLIDING SCALE FOR AGED SENIOR CITIZEN AND PERSONS WITH DISABILITIES AND LIMITED INCOME EXEMPTIONS.
“WHEREAS, each year the Greene County Legislature reviews the maximum income limits for the “Aged Senior Citizen’s Tax Exemption” and the “Persons with Disabilities and Limited Income Tax Exemption” for county tax purposes and,
WHEREAS, Greene County Real Property Tax Service recommends increasing the maximum income limits to $26,500 so those already receiving their exemptions continue to remain the same percentage brackets;
THEREFORE BE IT RESOLVED, subject to the language, The Town Board of Jewett moves to adopt the Greene County proposed Real Property Tax suggested sliding scale.”
Councilman McCrary made a motion, 2nd by Councilman Miles and moved to adopt Resolution #7 of 2017. SUBJECT: General Fund Transfer to balance budget.

Councilman McCrary made a motion, 2nd by Councilman Trach and carried the board moved to authorize the Supervisor of the Town of Jewett to sign a retainer letter between Attorney, Tal G. Rappleyea and The Town of Jewett.
A production company by the name of 495 Productions has approached the town to gain approval for possibly film a reality show with the cast living in a house in the town of Jewett. The board discussed zoning and safety issues as well as if a site plan approval or special use permit was needed. Tal Rappleyea, Attorney for the Town of Jewett will reply to the production company.
Whereas William Snyder has been put forward by Carol Muth, Therefore Councilman McCrary made a motion, 2nd by Councilman Miles and carried to appoint William Snyder as the Jewett Representative to the Greene County EMS board.
Councilman Trach made a motion, 2nd by Councilman McCrary and carried to approve the bills. General Fund was $25,813.89 on abstract #1, claim numbers 1-15. The Highway Fund was $2,324.37 on abstract #1, claim numbers 1-6.

The regular meeting of the Jewett Town Board was held on Wednesday December 14, 2016.
Supervisor Pellitteri called the meeting to order at 7:30 P.M. Present were Board Members Michael McCrary, Nathan Miles and William Trach. Absent was Allyson Constable. Also present was Tal Rappleyea, Esq. and the Town Clerk.
The Supervisor’s financial report was given to the Board prior to the meeting and the bank statements were reviewed by Board Members after the signing of the bills.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried the board moved to accept the minutes from October 12, 2016.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried the board moved to amend the minutes from November 9, 2016 as follows: The description of the storage container should be 8x8x20. In the second to last paragraph Councilman Trach made a motion and it was 2nd by Councilman Miles. At the end of paragraph 13 it was added, Town Attorney explained to the board members the difference in criteria for area variance and use variance according to section 267-B of the Jewett Town Law.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried the board moved to accept the amended minutes from November 9, 2016.
On a motion by Councilman Miles, 2nd by Councilman Trach and carried the board moved to accept the minutes from November 17, 2016.
While reviewing the Code Enforcement Officers report, board members had questions regarding certain open building permits. The Board placed a mark next to the open permit they would like more information about by the next board meeting.
On a motion by Councilman McCrary, 2nd by Councilman Miles and carried The Board moved to accept the Code Enforcement Officers report.
Discussions were had regarding the new zoning enforcement officer, Stacey Sprauge.
The board would like her to report quarterly at the town board meetings.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried The Board moved to authorize Jewett Town Supervisor, James Pellitteri to sign the contract with the Columbia Greene Humane Society.
The year-end meeting has been scheduled for Thursday December 29, 2016 at 5:30 pm in the Jewett Town Hall.
