Agenda Item 2- Acceptance of Minutes of November 2, 2022.
Mr. Kutcher made a motion, 2nd by Mr. Wrabel and carried the board accepted
The minutes from November 2, 2022 and carried unanimously.
The board then called Mr. Galloway to the floor to make sure he had all the appropriate paperwork in order. The board confirmed that Mr. Galloway and Ms. Bell had signed the certifications and hung up the required notice on their property and they produced all certified receipts showing that they had notified their neighbors of the public hearing. Mr. Galloway did not bring back the public hearing sign and was asked if he could return it to the town hall sometime during the week, which he agreed to do.
Agenda Item 3- Public Hearing for Area Variance for Todd Galloway and Elide Bell, 786 Goshen St. Jewett, NY Tax ID No. 112.00-1-20; Rural Residential Zoning District, 18.9 acres.
Ms. Miles made a motion, 2nd by Ms. Williams to open the public hearing at 7:02 pm for an application for Area Variance for Todd Galloway and Elide Bell.
There was public present. The following persons spoke in favor of granting the area variance:
Tom Hitchcock, Sheila and Paul Trautman, Ian Schwam, Vernon and Mary Ann Tompkins, Anthony Russo and Pengfei Zhang (Allen).
The following persons spoke against the granting of the area variance:
Al Olivieri.
On a motion by Mr. Kutcher, 2nd by Mr. Wrabel the board moved to close the public hearing at 7:16pm.
After the public hearing was closed Ms. Miles asked if the applicants had anything more they wanted to say. Mr. Galloway then presented the board with additional letters from the neighbors. The zoning board secretary read the letters aloud. The board then discussed Mr. Galloway and Ms. Bell’s request and reviewed the benefit to applicant weighed against the detriment to health, safety and welfare of the neighborhood.

Ms. Miles made a motion, 2nd by Mr. Coe and carried the board voted on the area variance.
ROLL CALL VOTE: Ms. Miles- NAY, Mr. Kutcher – AYE, Ms. Williams -AYE, Mr. Coe – NAY, Mr. Wrabel –NAY.
The vote was 3 NAYS and 2 AYES, the area variance was not granted.

Agenda Item 3- Application for Area Variance for Todd Galloway and Elide Bell, 786 Goshen St. Jewett, NY Tax ID No. 112.00-1-20; Rural Residential Zoning District, 18.9 acres.
The board reviewed Mr. Galloway and Ms. Bell’s application for a variance request.
The applicants had placed a solar array on the property in the front yard without obtaining a building permit or having the system inspected by a Greene county electrician. The town code enforcement officer issued a violation to Mr. Galloway and Ms. Bell and told them they would have to come into compliance by applying for a building permit. He then stated that if they were going to keep the solar array in the front yard, as it is not permitted to be placed there by town code, the building permit would be denied and the applicants at that point could apply for a variance. Due to the lack of a Greene County electrical inspection and in the interest of safety, the building inspector told Mr. Galloway and Ms. Bell that they would have to have the system disconnected by a licensed Greene County electrician. In September, the applicants had a licensed Greene County electrician disconnect the solar array. The electrician then provided proof to the building inspector that it was disconnected. The applicants then turned in a complete application for an area variance to appeal to the Zoning Board.
Mr. Galloway took the floor and explained their case to the board.
He said that when the solar array was placed, they were led to believe that the solar company, Albany Solar Solutions, had obtained all the proper permits. As for the placement of the system, they are seeking a variance to keep it located in the front yard. Mr. Galloway and Ms. Bell said there is no alternative area available to place the system. The applicants state that keeping the system in the front yard will not present any detriment to the health, safety, welfare or character/ beauty to the community.
Ms. Williams made a motion, 2nd by Mr. Coe and carried the board accepted Mr. Galloway and Ms. Bell’s application as complete and carried unanimously.

The vote was five ayes and the motion was approved.
Mr. Galloway was then given the required signage to post in front of the property, including all the adjoining property owners’ information so that they can begin to notify their neighbors of the public hearing which has been scheduled for December 7, 2022 at 7pm in the Jewett Town Hall.

There being no other business, Mr. Kutcher made a motion to close the meeting,
