The regular meeting of the Jewett Town Board was held on Wednesday, November 11, 2015. Supervisor James Pellitteri called the meeting to order at 7P.M. Present were Board Members Michael McCrary, William Trach and Nathan Miles. Also present was Town Attorney Tal G Rappleyea and the Town Clerk.
Minutes of the October 14, 2015 general meeting and the minutes of the October 29, 2015 special meeting were accepted on a motion by Councilman McCrary, 2nd by Councilman Trach and carried.
On a motion by Councilman McCrary, 2nd by Councilwoman Trach and carried, the Code Enforcement Officers report was accepted.
Highway Superintendent’s Report as Follows: We are continuing to prepare for the winter season.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried The Board adopted Resolution #30 of 2015. SUBJECT: Acceptance of the Preliminary Budget
“WHEREAS, the motion to override has been duly passed,
THEREFORE BE IT RESOLVED, The Town of Jewett Board moves to accept the preliminary budget for 2016 as the final budget.

“WHEREAS, The Town Board would like to create a position of deputy code enforcement officer and,
WHEREAS, The Town Board proposes Donald Muth to take the position,
THEREFORE BE IT RESOLVED, The Town of Jewett appoints Donald Muth as the Deputy Code Enforcement Officer, to be paid at the same pay grade as when he was working here previously.

Discussions were continued to be made regarding The Countywide Ambulance proposal.

“WHEREAS, the recent election resulted in a new Legislator being elected to represent the Town of Jewett in the Green County Legislature,
THEREFORE BE IT RESOLVED, that the Town Council of the Town of Jewett congratulates Ms. Lori Torgersen on her election and invites Legislator Torgersen to attend meetings of the Board at her convenience.
Councilman McCrary made a motion, 2nd by Councilman Trach and carried to approve the bills. General Fund was $27,388.74 on abstract #11, claim numbers 226-242. The Highway Fund was $44,852.54 on abstract #11, claim numbers 203-216.

A special meeting of the Jewett Town Board was held on Thursday October 29, 2015 to hold a public hearing on the proposed tax cap override law, a public hearing for the preliminary budget and any other business that may come before the Town Board. Supervisor Pellitteri opened the meeting at 5:02pm. Present were Board Members Michael McCrary, William Trach, Nathan Miles and Allyson Constable, as well as Newspaper Reporter Michael Ryan and the Town Clerk. Public present was Jim and Linda Varelas, Ronald and Sheila De Long, Carol Miles, Fred Fiandaca, Tom Hitchcock, Al Oliveri and Jo Ann De Long.
Councilman McCrary made a motion, 2nd by Councilman Miles and carried to open the public hearing at 5:11pm on local law #2 of 2015 entitled, “A local law to Override the Tax Levy Limit Established in General Municipal Law 3-c” and the public hearing for the preliminary budget.
Town residents asked the Board to take out of the budget any unnecessary expenses. Both residents and Board Members discussed the final numbers of the budget. Concern was expressed regarding the over budgeting of salt and sand for the winter season. Property owners felt that the Town should be buying salt and sand as needed, instead of overbuying in beginning of the season. The Highway Superintendent said that if we only buy the minimal amount in the beginning and run out in the middle of the winter, it will be much more expensive and harder to find salt and sand at that point. If we end up with salt and sand left over, that will be carried over to the next year and we won’t have to raise as much money thru taxes the following year. Tom Hitchcock took the floor and expressed his concern regarding the preliminary budget and not being able to find it on the town website, and that he did not have enough time to review the budget for the public hearing. He also wanted the Board to look into why both Fire Districts are not receiving the same amount of money. Board members assured Mr. Hitchcock that they will look more closely into the two Fire Districts budgets. Supervisor Pellitteri then thanked everyone for coming and speaking their concerns.

Discussions were made regarding the loader for the Highway Department; Supervisor Pellitteri informed the board that a bid was put in for a new one.
The meeting was adjourned at 5:51pm on a motion by Councilwoman Constable, 2nd by Councilman Trach.

The regular meeting of the Jewett Town Board was held on Wednesday, October 14, 2015. Supervisor James Pellitteri called the meeting to order at 7:04 P.M. Supervisor Pellitteri presented the Board with the preliminary 2015 budget. The Board reviewed the preliminary budget.

A public hearing on the Preliminary budget is scheduled for Thursday October 29, 2015 at 5:00pm at the Jewett Town Hall.
A public hearing on local law #2 of 2015 entitled “A local law to override the tax levy limit established in general municipal law 3-c” and any other business that may come before the town board, is scheduled for Thursday October 29, 2015 at 5:00pm at the Jewett Town Hall.
On a motion by Councilman McCrary, 2nd by Councilwoman Constable and carried The Board adopted Resolution #28 of 2015. SUBJECT: Authorizing the Town Superintendent of Highways to declare a surplus of machinery and sale giving permission to purchase new machinery up to a certain amount, subject to receipt of clarifying information.
“WHEREAS, The Town of Jewett’s Highway department presently owns a loader that is 20 years old and,
WHEREAS, the multitude of repairs don’t justify keeping it,
THEREFORE BE IT RESOLVED, The Town Board of the Town of Jewett authorizes the Highway Superintendent to declare a surplus and place loading equipment for sale and to purchase a new loader subject to receipt of clarifying information”.
Councilman McCrary made a motion, 2nd by Councilman Trach and carried to authorize the Town Supervisor to request a class for GIS training to be held at the Jewett Town Hall. Whereas, there was a request made from both planning and zoning boards for training on the GIS system.
Supervisor Pellitteri informed the board that he received a letter from Mang Insurance regarding the town’s current health policy thru CDPHP insurance. Mang will no longer be offering this plan and the board will have to review other plans in the next upcoming months.
Tal G Rappleyea, Attorney for the Town of Jewett, reported to the Board that he was contacted by Brett Hogan’s attorney regarding the fines that were issued to Mr. Hogans property. The Attorney is asking for possible leniency regarding the fines. The Board reviewed the issue and will continue to uphold the fines.

The regular meeting of the Jewett Town Board was held on Wednesday, September 9, 2015. Supervisor James Pellitteri called the meeting to order at 7:00 P.M. Present were Board Members Michael McCrary, William Trach, Allyson Constable and Nathan Miles. Also present was Robert Mallory, Highway Superintendent, Town Attorney Tal G Rappleyea, Newspaper Reporter Michael Ryan and the Town Clerk. Public present was Ron Rouse, Paul Macko and Carol Muth.
Minutes of the August 12, 2015 general meeting were accepted on a motion by Councilman McCrary, 2nd by Councilwoman Constable and carried.
On a motion by Councilman Trach, 2nd by Councilman Miles and carried, the Code Enforcement Officers report was accepted.
Highway Superintendent’s Report as Follows: It’s a slow time of year. The Highway Department has started bringing sand and salt in and have explored new places to purchase the materials at a lower price. CHIPS paperwork has been sent in and the check should come sometime in September. The truck that was sent out to be restored will be back next week. Superintendent Mallory met with a home owner who agreed to let the town make a turnaround area for snow plows during inclement weather in front of his property. The Highway crew reinstalled a snow fence that was removed while we were making the turn around. Maintenance has been continuing at the Maplewood Cemetery. Signs on Wright Road will be updated. Colgate Road has become very busy because of Colgate Lake and many people have been speeding down that road. Since it is not a town road, a letter will be sent to the Greene County Sheriff’s office to have them patrol it on the weekends.
Councilman Miles gave the Board an update as to what the Planning Board has been currently working on.
Ron Rouse, representative and staff of the Greene Countywide Ambulance task force took the floor to give an update to the Town of Jewett regarding how this plan would be implemented if it went thru and how the Town of Jewett would be affected. As Mr. Rouse expanded on the information, the supervisor and board members voiced their concerns. Mrs. Muth, former Supervisor and representative to the Greene County Task Force from Jewett, was also on hand to ask questions and voice concerns.
Maplewood Cemetery Update: Supervisor Pellitteri will be meeting with a family tomorrow to buy possibly 10 plots. Supervisor Pelliterri also signed the needed paperwork that is required to be filed with the courts to obtain permission to use the cemetery fund to buy equipment for the cemetery.
Discussions were continued regarding code review.
Other Business: There will be a Time Warner public service commissioners meeting. Bonnie Blader who spearheaded the Town of Lexington’s drive for broadband access will be involved. Time Warner is requesting the hearing because they are being taken over by another company. A letter will be written explaining how unhelpful Time Warner has been in expanding its cable network in Jewett. On another issue, Tal Rappleyea will be providing an updated retainer letter to the Town.

The regular meeting of the Jewett Town Board was held on Wednesday, August 12, 2015. There being the required quorum, Deputy Supervisor Michael McCrary called the meeting to order at 7:07 P.M. Present were Board Members Allyson Constable and Nathan Miles. Absent were Supervisor Pellitteri and Councilman Trach. Also present was Robert Mallory, Highway Superintendent, Newspaper Reporter Michael Ryan and the Town Clerk. Public present was Clarence Soule.
Minutes of the July 8, 2015 general meeting were accepted on a motion by Councilman Miles, 2nd by Councilwoman Constable and carried.
On a motion by Councilman Miles, 2nd by Councilwoman Constable and carried, the Code Enforcement Officers report was accepted.
The alarm situation from last month was discussed as a letter had been sent to the owner of the property. A fine was issued of $675 for four separate incidents, but Mr. Soule reported that there wasa fifth on the 1st of August.
Highway Superintendent’s Report as Follows: The highway crew has been completing shoulder work, sweeping ditches and cleaning spots up on the road. They also helped Greene County open up a beaver dam at the bottom of Carl Rd. Superintendent Mallory went on to explain a situation to the board. He said at the bottom of Mill Hollow Rd. where the new bridge went in, there is no place to turn around, since the flood washed out the house and it took away everything including where we turn around with the snow plows in the winter time. The property owner did not want to agree to have the town make a new turn around. So Superintendent Mallory approached another property owner about using their land for the town turn around. The property owner agreed and the highway crew started clearing out the space. Apparently the homeowner then became upset. According to town law, the Town has the right to make this space for turnarounds but Superintendent Mallory would like to handle everything cordially. He also wished to consult the Town Attorney.
Councilman Miles made a motion, seconded by Councilwoman Constable and carried to accept the Highway Superintendents report subject to his discussion with Tal Rappleyea, Esq.
Councilman Miles gave the Board an update as to what the Planning Board has been currently working on.
Councilman Miles made a motion, 2nd by Councilwoman Constable and carried to approve Resolution #23 Titled, Setting a fee structure regarding municipal housing for canines taken to the Columbia Greene Humane Society Housing Area.
“WHEREAS, The Town of Jewett held certain fees regarding housing of canines in the Columbia Greene Housing Shelter and,
WHEREAS, The Columbia Greene Humane Society has reset their scheduled fees for municipalities,
THEREFORE BE IT RESOLVED, that The Town of Jewett will set fees according to the Columbia Greene Humane Society Fees.

“WHEREAS, Resolution #19 of 2015 states in pertinent part that the Town “creates a permanent CM Fund,
THEREFORE BE IT RESOLVED, Resolution #19 of 2015 shall state that Town of Jewett creates a permanent CM Fund for the purpose of depositing general funds/income and expenditures for everyday needs.

“ WHEREAS, the Town of Jewett has previously accepted ownership, title and/or control over a cemetery named the Maplewood Cemetery located within the Town of Jewett, and
WHEREAS, the Maplewood Cemetery Association owned an account known as the Perpetual Fund of Maplewood Cemetery Association.
THEREFORE BE IT RESOLVED, that the Maplewood Cemetery Reserve Capital Account shall be and hereby is created, wherein the funds currently on deposit in the Perpetual Fund of Maplewood Cemetery Association, and be it further
RESOLVED, that any funds deposited in such account may only be utilized for upkeep, maintenance and capital needs of the Maplewood Cemetery and may only be accessed following the enactment of a resolution subject to a permissive referendum and approval of a Court of appropriate jurisdiction, and be it further
RESOLVED, that the within Resolution is made subject to a permissive referendum and shall become automatically binding following the expiration of 30 (thirty) days unless a petition is filed with the Town Clerk in accordance with the requirements of New State Law.

The discussion regarding the WAJ PTA request for a donation was tabled until the next general town board meeting scheduled for September 9, 2015 in order to enable all Board Members to express their opinions.

The regular meeting of the Jewett Town Board was held on Wednesday, July 8, 2015. Supervisor James Pellitteri called the meeting to order at 7:08 P.M. Present were Board Members Allyson Constable, Michael McCrary and Nathan Miles. Also present was Robert Mallory, Highway Superintendent, Town Attorney Tal G Rappleyea, Newspaper Reporter Michael Ryan and the Town Clerk. There was no public present.
Minutes of the June 10, 2015 general meeting were accepted on a motion by Councilman McCrary, 2nd by Councilman Miles and carried.
On a motion by Councilman McCrary, 2nd by Supervisor Pellitteri and carried, the Code Enforcement Officers report was accepted.
Councilman McCrary would like the Building Inspector to add two more categories to his monthly report. A line for re-inspections and another line for outstanding building permits, with a commentary section describing any ongoing issues that month.
There were also discussions regarding the fees charged in the Code Enforcement Officers Department.
Discussions were had regarding a homeowner who has repeatedly has false alarms going off in his house. The board reviewed the Town of Jewett’s Alarm Devices and Systems Law and will be taking the appropriate steps regarding fines.
The Board also discussed the town Noise Ordinance regarding another property owner who repeatedly leaves his many canines out at night with them barking which has a lot of neighbors upset for many years. The Board will take the appropriate next steps with this situation as well.
Highway Superintendent’s Report as follows: Paved Little Timber, Silver Springs and Carr Road this past week and last week. We re- broomed a few roads, cut some brush and are continuing to take care of the Maplewood Cemetery. Superintendent Mallory found a good price for refurbishing of an old plow and has come in under a $1,000 of what was originally expected. Supervisor Mallory was speaking about how it’s been difficult to get sand for the winter. We have a very good relationship with the Greene County Highway Department and with other municipalities on the mountain top as far as sharing sand. Councilman McCrary wanted to state for the record that we are grateful for the intermunicipal sharing and cooperation, which Governor Cuomo wants municipalities to do and we have already been doing it.
Councilman McCrary made a motion, seconded by Councilman Miles and carried to accept the Highway Superintendents report with the following comment: The Board is so impressed and grateful for the work that was done on the paving and extremely impressed with the work that was done on the Maplewood Cemetery, with the gates being fixed and the place is looking exceedingly well. It’s a great benefit to our town and of course to our residents and past residents who happen to be in there.
Councilman Miles gave the Board an update as to what the Planning Board has been currently working on.
Maplewood cemetery update: Data entry of putting all the records onto an excel spreadsheet is almost complete. New forms have been printed out clarifying burial plot locations.
Councilman Miles made a motion, 2nd by Councilman McCrary and carried to cover 75% of the cost to correct a wrong burial that happened with the local family to cover 25% of the cost at the next opportune time that the equipment is there.
Discussions were made regarding possible improvements to the Town Hall Building.
The Board discussed the ongoing issue of Trek Vest and how at the last meeting it was agreed that Kyle Burn would drop off the paperwork from DEP regarding the hold up of his project. Mr. Burn never dropped off any paperwork.
The Planning Board would like to get official badges from the Greene County Sheriff’s office so that all of the members would have the appropriate credentials when meeting with property owners. Supervisor Pellitteri asked Councilman Miles to get all the members names and information to him and he will reach out to the Greene County Sherriff’s office to make the arrangements.
The town board continued to review what the Code Review Board has done up to date.
Other Business: The townof jewett.com website will be linked to townofjewett. org website as soon as possible.
The Board reviewed the Greene County Wide Ambulance proposed new costs.
Councilman McCrary made a motion, 2nd by Councilwoman Constable and carried to approve Resolution #22 Titled Amending Local Law #3 of 2008 Flood Prevention Local Law.
“WHEREAS, the Town Board of the Town of Jewett enacted Local Law #1 of 2015 entitled, “Amending Local Law #3 of 2008 Flood Prevention Local Law” on May 13, 2015 which included information provided by the NYS Department of Environmental Conservation regarding the date of the completion of mapping therein, and
WHEREAS, such date was incorrect and must be amended; and
WHEREAS, in accordance with 19 NYCRR 130.5 and NYS Executive Law 91 the Town may effectuate a “technical correction” to a previous enacted local law.
NOW, THEREFORE ,BE IT RESOLVED, that the Town Board of the Town of Jewett hereby adopts a technical correction of Local Law #1 of 2015 in accordance with 19 NYCRR 130.5 and NYS Executive Law 91 as follows: deleting section 3.2(2) reference to May 16, 2008 and replacing it with June 2, 2015 and it is further
RESOLVED, that the Town Clerk and the Attorney for the Town are directed to execute and file any necessary documents to complete the within correction of the said Local Law #1 of 2015.

The regular meeting of the Jewett Town Board was held on Wednesday, June 10, 2015. Supervisor James Pellitteri called the meeting to order at 7:00 P.M. Present were Board Members Allyson Constable, Michael McCrary, Nathan Miles and William Trach. Also present was Robert Mallory Highway Superintendent, Newspaper Reporter Michael Ryan and the Town Clerk. Public present was Werner Pscherer, Richard Shippee Code Enforcement Officer, Lynne Teator, Kyle Byrne, Laura Pierce and Gregory Kroyer.
Acceptance of the minutes of the May 8, 2015 general meeting was tabled until Town Attorney Tal Rappleyea arrived.
Kyle Byrne of Trek Vest took the floor and gave an update of how his project is going at the old drive in theatre. Unfortunately progress has come to a temporary halt as DEP has changed their requirements for approval. This change will require Mr. Byrne to put out much more money than he originally had expected. The Board doesn’t understand why DEP has incorporated this new change and asked Mr. Byrne to bring in his paperwork from DEP so they can take a look at it and see if there is anything the town can do on his behalf.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried, the Code Enforcement Officers report was accepted.
Lynne Teator, resident of the Town of Jewett took the floor to speak about her landlord, John Vitelli regarding violations on the property where she is living. Code Enforcement Officer, Richard Shippee addressed the issues and said he has been in contact with Mr. Vitelli about correcting the violations. If they are not completed in a certain amount of time the town will take the appropriate next steps.
Highway Superintendent’s Report as Follows: Basic regular summer things going on. Patching, fixing spots with pot holes and fixing culvert pipes. Little Timber, Silver Springs and Carr Roads will be paved this summer. We have been taking care of grooming the cemetery. The new mower and trailer have arrived and will be housed in the back of the Highway Dept. The highway crew just got done weed eat & mowing, which took approx. 28 hrs. Next, they will concentrate on fixing a fence that was damaged by a plow years ago. It is extremely bent and so we will pull it out of the ground and straighten it out along with repainting it. Councilwoman Constable wanted to compliment Superintendent Mallory and the Jewett Highway crew on a job well done regarding Maplewood Cemetery. She said her father goes there every day and notices all the improvements that have been done and has commented to her that it is a place of comfort for him and to go there and have it look as nice as it has been looking has meant a lot to him.
The new bridge had been completed on Carr Road and was very well done by Greene County.
Superintendent Mallory would like permission from the board to obtain bids to have an old plow sandblasted which could be anywhere between $3500-$5000. He also would like to restore a sander, about $2500.
On a motion by Councilman McCrary, 2nd by Councilman Miles and carried, the board gave Superintendent Mallory permission to obtain bids for the restoration of an old snow plow and a sander.
Discussions were had regarding the preparations of Taste of Country. There were some complaints about the RV’s at Bear Creek, leading the board to have concerns regarding the Jewett Airport and Demming Road sites.
The town board reviewed what the Code Review Board has done up to date.
Supervisor Pellitteri made a motion, seconded by Councilman McCrary and carried to thank Donna Bernard for all her hard work in organizing the ongoing meetings regarding code review, keeping everyone on track and following up with notes. She has been absolutely fabulous.
Other Business: There is an issue on Carr Road as to the uncertainty of what the speed limit is. There is no sign there as it got washed away in the flood of 2011. There was a resolution done in 2001 which was incorrect as it only dealt with little timber road- which by the way was stated as being to the east of Carr road and really is located to the west. Councilman McCrary would like to clarify this.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried The Board adopted Resolution #21 of 2015. SUBJECT: Reclarifying Resolution #3 of 2001 to agree with the minutes of August 2001.
“WHEAREAS, in the minutes of January 10, 2001 Resolution #3 stated that for safety matters the speed limits on Little Timber Road and Demming Road was reduced and,
WHEREAS, this was an incorrect description of the roads and,
WHEREAS, there was a mention in the August, 2001 minutes that is correct as to the reduction of the speed limit,
THEREFORE BE IT RESOLVED, that resolution # 3 of 2001 be amended to read as per the minutes of August, 2001 to reduce the speed limits of Demming Road to 25 MPH, Carr Road, Silver Springs Road and Little Timber Road to 30 MPH. to have the record correct”.

Other business continued: The Town of Jewett’s equalization rate is at 100%, which mean we are up to date with current property values. The coalition of Watershed towns has nominated Councilman McCrary to sit on their board, along with some other nominees. They are asking for all the towns to send in a vote for whom they would like to see sit on the board.
Councilman Miles made a motion, seconded by Councilwoman Constable and carried to vote for Councilman McCrary to sit on the board of the coalition of Watershed Towns.
Councilwoman Constable made a motion, seconded by Councilman Trach and carried to make a $100 donation the Sprouts program.
Councilman McCrary made a motion, seconded by Councilwoman Constable and carried to thank The Greene County Highway Department for a job well done constructing the bridge on Carr Road.
Laura Pierce took the floor to ask for help regarding a short term rental on Cramer Rd that leaves about 7-8 huge garbage bags out on the road after the weekends, which she has had to dispose of so the bears and animals don’t get into it and make a mess. The renters are loud at all hours of the night and they park their many cars on her drive way. Supervisor Pellitteri suggested that she document all the issues when it happens. The town will be able to help once she has the proper documentation.
Councilman McCrary made a motion, 2nd by Councilman Trach and carried to approve the bills. General Fund was $21,448.81 on abstract #6, claim numbers 122-147. The Highway Fund was $7,753.87 on abstract #6, claim numbers 117-133.
Councilman Trach made a motion, 2nd by Councilwoman Constable and carried to accept the Supervisors financial report for May.
On a motion by Councilman McCrary, 2nd by Councilman Miles and carried the Board went into Executive Session at 9:03 P.M. to discuss personnel matters, “The medical, financial, credit or employment history of a particular person or corporation, or matters leading to the appointment, employment, promotion, demotion, discipline, suspension, dismissal or removal of a particular person or corporation.”

The regular meeting of the Jewett Town Board was held on Wednesday, May 13, 2015. Supervisor James Pellitteri called the meeting to order at 7:01 P.M. Present were Board Members Allyson Constable, Michael McCrary, Nathan Miles and William Trach. Also present was Robert Mallory, Highway Superintendent, Town Attorney Tal G Rappleyea, Newspaper Reporter Michael Ryan and the Town Clerk. Public present was Donna Bernard Planning Board Chair, Nancy Bower Assessor for the Town of Jewett, Rick Rosa, Peggy Booth, Richard Fusco, Gregory Kroyer, Barry Esbin, Burce Transue, Russ Coloton and Paul LaPierre.
The Supervisor’s financial report was given to the Board prior to the meeting and the bank statements were reviewed by Board Members after the signing of the bills.
On a motion by Councilman McCrary, 2nd by Councilman Miles and carried, the public hearing regarding Local Law #1 entitled FEMA New Regulation Law was opened at 7:01 PM.
No one from the public had any comments regarding the potential new law.

On a motion by Councilman McCrary, 2nd by Councilman Miles and carried, Local Law #1 of 2015 was adopted. This law is entitled, “Amending Law #3 of 2008 Flood Prevention Local Law”.
“Section 1. The Town Board of the Town of Jewett enacted Local Law #3 of 2008 entitled “Flood Prevention Law” which included adoption of certain maps created by FEMA and referred to in Section 3.2 thereof.
Section 2. FEMA has amended the above-referenced maps and therefore Local Law #3 of 2008, Section 3.2 shall be replaced and hereby is amended as follows:
The areas of special flood hazard for the Town of Jewett, Community Number 361114, are identified and defined on the following documents prepared by the Federal Emergency Management Agency:
(1) Flood Insurance Rate Map Panel Numbers 36039C0187F, 36039C0190F, 36039C0191F, 36039C0192F, 36039C0193F, 36039C0194F, 36039C0211F, 36039C0213F, 36039C0214F, 36039C0218F, 36039C0219F, 36039C0238F, 36039C0239F, 36039C0352F, 36039C0355F, 36039C0356F, 36039C0357F, 36039C0360F, 36039C0376F, 36039C0381F, 36039C0382F, whose effective date is May 16, 2008, and any subsequent revisions to these map panels that do not affect areas under our community’s jurisdiction.

Minutes of the April 8, 2015 general meeting were accepted on a motion by Councilman McCrary, 2nd by Councilman Trach and carried.
On a motion by Councilman McCrary, 2nd by Councilman Constable and carried, the Code Enforcement Officers report was accepted.
Discussions were made regarding a house on 296 which has received many complaints regarding deterioration of property and unstable structure of home. The town has sent numerous letters to the owner over the last year and has not received any response. It was decided that a final letter will be mailed to 2 addresses that was found for the owner and if we do not hear from them, we will proceed to go into the house to check for safety issues.
Highway Superintendent’s Report as Follows: We have been concentrating over across the stream where the new bridge is going in on Carr Road. We’ve cut shoulders, put in new culvert pipes, ditched and preparing for paving across Carr Road Bridge. Everything is going well. Superintendent Mallory reported on the different quotes he obtained for a mower and small utility trailer that would be used for the maintenance of Maplewood Cemetery.
Bids for Black top were received and opened.
1) Callanan Industires bid $66.26 per ton installed.
2) Peckham Industries bid $64.48 per ton installed.
3) Cobleskill Stone Products bid $68.95 per ton installed.
Councilman McCray made a motion, 2nd by Council Miles and carried to adopt resolution #18 of 2015. Subject: Accepting the Bid from Peckham Industries for Black Top for the Town of Jewett.
“WHEREAS, the Town of Jewett is in need of black top and,
WHEREAS, the Highway Superintendent has recommended the bid by Peckham Industries,
THEREFORE BE IT RESOLVED, we award the bid to Peckham Industries at the rate of $64.48 per ton installed.”

Richard Fusco took the floor to give an update on his application for a public assembly permit to use the Jewett Airport site and Demming Rd. for extra parking regarding RV/ car camping during the Taste of Country Festival. Martin Schmidt from Kaaterskill Associates took the floor to review the airport area. He said it won’t be primarily used for RV’s but just in case the weather is not in their favor, they would have a backup plan. Mr. Schmidt brought the Turco and Big Top contracts to show the board, as requested. A letter was provided from NYS police, showing acknowledgement regarding plans for Mountain Jam and Taste of Country Festivals. Mr. Schmidt also provided a contact/ emergency list of names to the town. A certificate of insurance was requested by the board but because that usually is issued the day before, it was not submitted as of yet. Mr. Schmidt then set up a large map to show the proposed site plan and answered any questions the board or local residents may have had.
On a motion by Councilman McCrary, 2nd by Councilman Constable and carried, the town approved usage of the Airport site/ IO Slutsky for usage during the Taste of Country Festival and Mountain Jam, pending insurance requirements and NYS Dept. of Health approval.
Mr. Schmidt continued onto the Demming Rd. Site, showing the revised proposed site plan. Russ Colton took the floor and said no tickets have been sold for this site at the moment and that there are still open spaces in the Hunter Mountain and bear creek sites. In two weeks, they don’t think that they will sell out, so there may be a maximum amount of possibly 20 RVS, if that. Councilman Miles asked if they had notified the area residents through the mail of their intent to use Demming Road during the festival, of which they replied yes. The Board wanted to know if they included a contact list for emergencies or a hotline number which residents could call in case there was a problem. Mr. Schmidt answered that they had not included the list but they will be sending it out in a second mailing. Councilman McCrary suggested giving local residents who live on Demming Road some sort of bracelet or tag allowing them easy access to their properties, which the festival people agreed to do. Again, Mr. Schmidt asked the board if there were any questions, which they answered. Supervisor Pellitteri said that if an RV is somehow stuck on the main road, he would like the manager of the site to call the Greene County Sheriffs right away and not to wait until there is a two, three or four back up of rv’s on the road. Mr. Fusco agreed.
Paul LaPierre, Demming Rd. resident took the floor and asked about trash removal during and after the festival stating that last year there was a lot of garbage left over for two weeks. Mr. LaPierre, his wife and other residents had to clean up the site themselves. Mr. Schmidt answered that they will have a trash removal company this year that will take care of any and all garbage during and after the festival. Mr. LaPierre was also concerned about security which both Mr. Schmidt and Mr. Fusco assured Mr. LaPierre and the Board that there will be 24 hour security on site of Demming Road. They also have agreements in place with NYS State Police and Greene County Sheriffs that will be permanently stationed not only at Hunter Mountain but throughout the town and parking areas. Mr. LaPierre ended his questions with this statement. “I have to say my next door neighbors are respective to your responses to my questions; still we prefer not to have it on Demming Road, that being said, we think you basically pretty well addressed the issues. Quite frankly I would prefer it not to be there either; it’s disruptive on a quiet country road.” Mr. Fusco responded by saying, “I appreciate listening to everything you had to say and understanding that we are really conscious of doing our best.”
Councilman Miles said, “I just wanted to encourage that in whatever measure you’re already trying to do this that whatever you can do to make this as pleasant as possible for the neighbors because of the problems of last year. If that happens again I know personally I would not be able to vote on this and think everyone feels the same way so just whatever can be done above and beyond to really respect those living in the area would be something we would request.”
Russ Colton took the floor and said, “I would like to speak on behalf of Hunter Mountain, I think I know most everybody here. I am the president and CEO of Hunter Mountain and a resident of Jewett. I want everyone to know that these events are important to the entire mountain top in a very slow period of time but having said that, we all are neighbors here and we live here and we want to make sure that we can mitigate any potential problems or any potential concerns we have and deal with them as quickly as we can. All our staff and I live at the mountain 24 hrs a day basically during all these events. I am on call and I am glad to give Paul my cell phone number if you have any concerns, please give me a call and we will do whatever it takes. I am speaking on behalf of my ownership and everyone else. We appreciate the board moving on this and approving it and we also want to make sure that this is a long term relationship that we have with Richards’s people and so we want to make sure it works for everybody. We don’t want to be here a year from now and you guys saying that you promised all this and none of it happened. We live here. That’s all I wanted to say”.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried, the town approved usage of Demming Rd. for The Taste of Country Festival and a public assembly permit pending insurance requirements and NYS Dept of health approval.
Peggy Booth, representative of NBT Mang Insurance agency took the floor and presented different options for the renewal of the insurance plans for town employees.
Councilman McCrary made a motion, 2nd by Councilman Trach and carried to renew CDPHP as our health insurance carrier for the upcoming year.

“WHEREFORE, Resolution #17 of 2015 says we create a trust and agency fund,

Discussions were made regarding the Greene County Ambulance proposal. We are waiting on Windham’s decision, seeing that we pay them.
Other Business: Discussions were made regarding the upcoming Tour of the Catskill’s bicycle race. An e-mail will be sent to the race coordinator regarding a letter of support from The Town of Jewett. Councilman McCrary brought up an issue of the town of Jewett’s nomination to the CWC. Councilman McCrary requests Supervisor Pellitteri to notify Jeff Baker of Councilman McCrary’s nomination to the CWC.
Greene County will be having a Hazards waste day on June 6, 2015. A link will be placed on the Town of Jewett’s website for more information.

Highway Superintendent’s Report as Follows: Looks like we are finally closing in on our large FEMA project reimbursements. We received FEMA project closure letters last week and their funding reimbursements match ours, all good. We have been sweeping our town highways with 30+ miles complete with less than 10 miles to go, again all good. Minor touch ups may be necessary. This winters frost was the worst I’ve seen in many many years. Damages were limited to several potholes and sinkholes. Some culvert pipes have heaved but I believe they will settle back in with the exiting of all frost. One of trucks needed some repairs this week. It needed all new injectors and headwork done. Since the truck is under warranty, we did not have to pay for it.
Richard Fusco of The Taste of Country Festival took the floor to give an update of progress regarding their application for a mass gathering permit. “Things have changed. We are realizing that the audience for the Taste of Country festival primarily likes to RV/ Car Camp and whereas the production team for the festival was looking at 3 sites for temporary camp grounds, the Demming Road property has become the most desirable, with the Airport property 99% being used only for parking. We have just received word from the NYS Dept. of Health that after doing extensive work on developing these areas for temporary campground permits, we have now been told that these properties will come under the mass gathering permit with camping requirements according to the agricultural fairground campgrounds requirements. NYS has various campground/ permit requirements but none of them really address what a music audience is all about which is basically that the campground is a place you go at night to sleep and most of the time they are over at the stage watching the show. A lot of these requirements that they have are geared towards campgrounds where people are spending a significant amount of time. So we are dealing with the fact that the Dept of Health is adjusting and it is frustrating to us because we go thru the temporary campground application and now we have to shift. So that’s where we are right now”.
Martin Schmidt of Katterskill Associates took the floor and said, “We are not ruling out RV’s at the airport and we are continuing to try to get approval for that site as well. But mostly we are gearing towards the Demming site for the rv’s”. Mr. Schmidt shared with the board their sketches of the layouts of the rv’s and car spots according to the requirements given to them by NYS Health Dept. The town then proceeded to ask detailed questions about the sizes of the parking spaces for the rv’s and car camping. He relayed to the Board that there will be no open fires or cooking permitted in the car camping areas. There will be a separate designated area for grilling that will have fire control apparatus.
Tal G Rappleyea attorney for the town requested copies of contracts with Turco the water supply company and Big Top who will be supplying the portolets. He also requested a written plan for the EMT and Security coverage. Mr. Schmidt will also supply their insurance contracts, insurance certificate etc. The town would also like a contact list of phone numbers to call in case there is a problem during the festival.
Supervisor Pellitteri had a concern about traffic regarding the fire department having access to the sites, as well as getting written permission from the town. Mr. Schmitd explained that he has met with both the Jewett and East Jewett Fire Departments. Mr. Schimidt will also provide a written statement from the Jewett Fire Department as well as the Sheriff’s Department to the town relating their plans for the weekend event. Also, Supervisor Pellitteri would like signs posted on 296 especially where there are sharp curves and turns. Mr. Schmidt said he will be working on this.
Bruce Transue of Hunter Mountain took the floor and related how there is a property owner on 296 that has many dogs. The dogs are very loud and bark 24 hrs a day. He finds dog droppings around the woods and this has been going on for many years. Mr. Transue cannot put up with this anymore as he cannot go thru any more sleepless nights and is seeking the help of the town. He is also concerned that it might be a puppy mill and that the dogs may not be properly taken care of. The town suggests that he documents the occurrences and that he contact Missy Runyon of FFF Wildlife to help.
Councilman McCrary made a motion, seconded by Councilman Trach and carried to accept Wayne Bunce’s resignation from The Board of Assessment Review.

Supervisor Pellitteri met with Richard Harty again this week. All the trustees signed responsibility and all assets over to the Town of Jewett. Funds can now be segregated to be used for what the town deems necessary.

“WHEREAS, there has been established in this Town a cemetery known as the MAPLEWOOD CEMETERY ASSOCIATION, INC., which association maintains a public cemetery on 23A in Jewett , Greene County, New York, and owns real property in said Town, and
WHEREAS, said association has under its care certain funds for perpetual care, permanent
maintenance, special trust, general, deposited in the following banks ; First Niagara Bank , Greene County Savings Bank and Key Bank .
WHEREAS, the association has been and still is unable to procure sufficient income from above investments, the members of the association and from the representatives of the deceased persons interred in the cemetery.
WHEREAS, the cemetery association has requested that the Town of Jewett, pursuant to Section 1506(j) of the Not-for-Profit Corporation Law, accept the conveyance of the cemetery premises and transfer of assets.
THEREFORE BE IT RESOLVED, That the Town of Jewett accept the conveyance of the cemetery premises and the transfer of the assets from the cemetery association, such conveyance shall be subject to all agreements as to lots sold and all trust, restrictions and conditions upon the title or use of the real property or assets”.

FEMA is requiring the town to change its flood prevention law, meaning that if you build in a flood zone this is where you have to build to prevent flood damage. The law incorporates in it all the FEMA maps to show numbers, slides and panels. FEMA wants us to amend our law to reflect the new maps and new numbers and if we don’t we will be disqualified from the national flood insurance program. A public hearing will be held at the next board meeting on May 13, 2015 to amend the current flood prevention law and incorporate the new maps to the same law. An ad will be placed in the newspaper notifying residents.
Other Business: A Letter was received from Bruce Feml, Dog Enforcement Officer suggesting the town create a tethering law for dogs. The town continued to discuss the parking situation regarding Demming Road and Councilman Trach is concerned about damage being done to the area and would like to make a provision in the mass gathering permit that would require them to be responsible for damage caused during the weekend of the festival. Also, the town board agreed that they would like Katterskill Associates, the company that is handling all permits for the festival promoters to send letters to local residents located around Demming Road explaining what they will be planning to use that site for during the Taste of Country Festival. The town of Hunter reached out to the town regarding the camp they run in the summer for children. In the past, Jewett has paid $95 per child towards summer camp tuition for their residents.

The regular meeting of the Jewett Town Board was held on Wednesday, February 11, 2015. Supervisor James Pellitteri called the meeting to order at 7:00 P.M. Present were Board Members Allyson Constable, Michael McCrary, Nathan Miles and William Trach. Also present was Robert Mallory, Highway Superintendent, Town Attorney Tal G Rappleyea, Newspaper Reporter Michael Ryan and the Town Clerk. Public present was Town Historian Janet Nicholls, Darren Elsom and Richard Fusco.
A moment of silence was taken to remember the 7 marines and 4 soldiers who were killed in a helicopter crash.
The Supervisor’s financial report was given to the Board prior to the meeting and the bank statements were reviewed by Board Members after the signing of the bills.
Minutes of the February 11, 2015 general meeting were accepted on a motion by Councilman McCrary, 2nd by Councilman Miles and carried.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried, the Code Enforcement Officers report was accepted, provided that the heading on the monthly report be changed from Building Inspector to Code Enforcement Officer.
Highway Superintendent’s Report as Follows: There were very minimal breakdowns with the snow equipment this winter and we have not run out of sand. The highway crew is now starting to transition into spring duties. Councilman McCrary wanted to commend Superintendent Mallory on a fine job of maintaining and caring for the people of Jewett’s roads this winter season. Supervisor Pellitteri seconded Councilman McCrary’s comments.
Richard Fusco and Darren Elsom Took the floor to apply for a mass gathering permit for use of the Jewett Airport regarding extra parking during the Taste of Country Festival. The Board asked questions about their plans and they will drop off their application for the permit on Thursday March 13, 2015.
On a motion by Councilman McCrary, 2nd by Councilman Miles and carried The Board adopted Resolution #12 of 2015. SUBJECT: Reappointment of Cynthia LaPierre to be the Town of Jewett’s Planning Board Representative to the Greene County Planning Board.

Discussions were made regarding the job description and duties of a Zoning Enforcement Officer. The Zoning Board will be consulted as to what they expect in a ZEO Officer.
Supervisor Pellitteri met with Richard Hardy, caretaker of the Maplewood Cemetary and received a lot of information regarding how the cemetery is run. The town may have to take over the Maplewood Cemetery in the very near future. Discussions were made regarding the details of operation.

Other Business: Anthem Sports will be having cycling events during the month of June and July. The Town of Jewett has always supported these events in the past. Councilman McCrary will attend the first meeting of the season to find out the details of the races.
The Albany Devils Hockey Team has invited the towns of the Mountain Top to have a community night at an upcoming Albany Devils game. There would be a discounted ticket offer of $13 per person. Tickets would include a poster giveaway, post game autograph session & post game public skate.
Discussions continued regarding extending the town hall to include a records room.

Highway of Superintendents Report as Follows: Lots of snow. We have been using much materiel; the men on the highway crew have been fantastic. Councilman McCrary wanted to recognize, Town of Jewett Highway member, Whalen McCullar who helped a person who fell in a ditch today. Superintendent Mallory spoke with Town of Jewett Judge, Steve Canfield about building extra space under the court room and Judge Canfield said we could possibly get a grant. Mr. Mallory had two phone calls of concern regarding Scribner Hollow Rd. He immediately took the loader and men and went and scraped the road.
Town Historian Janet Nicholls gave her annual report to The Town Board.
Councilman McCrary made a motion, 2nd by Councilmen Miles and carried, The Town Historians annual report was accepted. Supervisor Pellitteri thanked Ms. Nicholls for a job well done.

Supervisor Pellitteri brought up the open Zoning Enforcement Officer position and asked Board Members to go over the job description.
Shabby Ranch Update: Jeff Prince took the floor and shared how the transfer of shares from Goldman Properties to Catskill Resort Lodging has finally taken place. With this being done, the property can now continue to move forward with compliance, weather permitting. Mr. Prince also commended the Town of Jewett Highway Department for doing a great job with snow removal on all town roads.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried, the Board accepted the annual report from the East Jewett Fire Department. Councilman McCrary would like to set up a joint meeting between the town and the two fire companies.

The Superintendent of Highways shall be authorized to purchase under County and/or State Contract without competitive bidding.
PAID HOLIDAYS:
New Year’s Day, Martin Luther King, Jr. Day, President’s Day, Memorial Day, Fourth of July, Labor Day, Columbus Day, Election Day, Veteran’s Day, Thanksgiving Day and Christmas.

Highway Superintendents Report as follows: We have used two thirds of our salt and sand supply this year so far, running a little heavy but I have made arrangements to replenish our deicing supply if the need arises. One of the heaters in our shop which was provided and funded by Cornell Cooperative extension has a blown fan motor; fan motor will be repaired expeditiously. All highway snow plowing and deicing equipment is operating perfectly. We have received $10,000 from FEMA for the Ford Hill Project. A couple of weeks ago Whalen McCullar who is a member of the Town of Jewett Highway Department noticed that a homeowner had left their door open during the sub degree weather. Not knowing who the homeowner was, Mr. McCullar reported the incident to the town Assessor who was able to track down the homeowner. A neighbor was then called by the homeowner to go and close the door. The Homeowner was extremely thankful that Mr. McCullar had noticed this and cared enough to track him down.

Other Business: Councilman McCrary attended a meeting in Lexington regarding internet access.
It was agreed that if the Town of Jewett combined efforts with the Town of Lexington, we would have a stronger base to rally for internet access.
Councilman McCrary made a motion, 2nd by Councilman Miles and carried to support the Town of Lexington in their efforts to secure internet access and participate where and when needed.
Councilman Trach brought up the issue of Ash Trees being invaded by the Emerald Ash Borer. He wants the board to think about what we are going to do here in the Town of Jewett to handle this.
On a motion by Councilman Miles, 2nd by Councilman Trach and carried, the board adapted resolution #6 of 2015. Subject: Adopting the Greene County Suggested Sliding Scale for Aged Senior Citizen and Persons with Disabilities and Limited Incomes Exceptions.
“WHEREAS, each year the Greene County Legislature reviews the maximum income limits for the “Aged Senior Citizen’s Tax Exemption” and the “Persons with Disabilities and Limited Income Tax Exemption” for county tax purposes and,
WHEREAS, Greene County Real Property Tax Service recommends increasing the maximum income limits to $24,500.00 so those already receiving their exemptions continue to remain in the same percentage brackets;
THEREFORE BE IT RESOLVED, subject to the language, The Town Board of Jewett moves to adopt the Greene County proposed Real Property Tax suggested sliding scale.”
