The regular meeting of the Jewett Town Board was held on Wednesday November 9, 2016.
Supervisor Pellitteri called the meeting to order at 7:01 P.M. Present were Board Members Allison Constable, Michael McCrary, Nathan Miles and William Trach. Public present was William Mead.
Also present was Tal Rappleyea, Esq. and the Town Clerk.
The Supervisor’s financial report was given to the Board prior to the meeting and the bank statements were reviewed by Board Members after the signing of the bills.
On a motion by Councilman McCrary, 2nd by Councilwoman Constable and carried The Board moved to open the public hearing for proposed law #4 0f 2016 entitled, “Tax Cap Override” at 7:01 pm.
No one from the public commented.
Councilman McCrary made a motion, 2nd by Councilman Trach and carried to close the public hearing at 7:01 pm.
There being no need for the tax cap override, Councilman McCrary moved to open the public hearing for the Town of Jewett Preliminary Budget at 7:02 pm, 2nd by Councilman Miles and carried.
No one from the public commented.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried, the board moved to close the public hearing for the budget at 7:03 pm.
Voting to adopt the Preliminary Budget for 2017.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried The Board adopted Resolution #35 of 2015. SUBJECT: Adoption of the 2017 Preliminary Budget
“WHEREAS, the motion to override has been duly passed,
THEREFORE BE IT RESOLVED, The Town of Jewett Board moves to adopt the preliminary budget for 2017 as the final budget.”

Discussions were had regarding the minutes of October 12, 2016. Councilman Miles had wanted certain wording to be added into the minutes regarding the new fee schedule for alarm systems. Board member Miles suggested that a policy be drawn up regarding the notification of fines for false alarms, stating that before a fine can be given the homeowner must be duly notified by the town of this new law and given the opportunity for fair due process, where no one would receive a $150 fine without first getting a $0 fine. Supervisor Pellitteri did not agree stating that the proposed policy that councilman Miles is offering would be very complicated to carry out, given the fact that we don’t always get notified by the Fire Company sometimes until after several false alarms have occurred or months later. Supervisor Pellitteri then said the homeowners are actually notified by their alarm companies, property owners are in fact aware that a false alarm has gone off and if they are not alerted, it is their responsibility to contact their alarm company to have notification given to them if their system is activated. It is not the towns or the fire company’s responsibility. Councilwomen Constable then said it is not the responsibility of the town to make sure all residents know all the laws of Jewett but it is up to the property owners to be responsible to find out what the laws in the town are that they live in. Supervisor Pellitteri then said he would like to review last month’s recording of the meeting before deciding on a policy.
Minutes of the October 12, 2016 meeting were tabled by Councilman McCrary, 2nd by Councilman Miles and carried.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried The Board moved to accept the Code Enforcement Officers report subject to review on permit procedure.
The floor was opened to Jewett town resident, William Mead. Mr. Mead took the floor and asked the Town Board for help regarding his variance application to the Zoning Board of Appeals, explaining that they had denied him a variance and he did not agree with their decision. Supervisor Pellitteri told Mr. Mead that the zoning board is their own board and that the Town Board cannot over rule their decisions. The Board then told him that since he was denied, he would have to apply again and this time to have in writing the extensive monetary amounts that would have to be spent in order to achieve the same method other than a variance. Mr. Mead thanked the Board for listening and then left the meeting. Town Attorney Rappleyea explained to the board the difference in criteria for area variance and use variance according to section 267-B of the Jewett Town Law.
On a motion by Councilman McCrary, 2nd by Councilwoman Constable and carried The Board moved to authorize the Deputy Supervisor to sign the activity indemnity on behalf of the Town Board.
Tal Rappleyea, attorney for the town, has been in contact with Mid-Hudson Cablevision to see if they would be interested in providing their services in an area of the town that Time Warner has not been servicing. Mid- Hudson says that they are willing but would like Time Warner to put in writing that they are not interested in the area of question.
Other Business: Councilman Trach shared with the board information he had acquired regarding the purchase of an 8x8x20’ container for record storage. Board member Trach stopped by and spoke with C&C Containers in Durham and received several price quotes for different size containers. Containers can either be sold or rented.
On a motion by Councilman Miles, 2nd by Councilman McCrary and carried The Board adopted Resolution #36 of 2016. SUBJECT: AUTHORIZATION OF PURCHASE OF A CONTAINER FOR RECORD STORAGE USAGE.
“WHEREAS, The Town of Jewett is required by NYS Law to retain certain records inevitably and,
WHEREAS, the physical building where the municipality is located is not large enough to store all the records properly and,
WHEREAS, the need for extra records storage exists,
THEREFORE BE IT RESOLVED, the Town of Jewett authorizes Records Officer, Maya Carl, to purchase a temporary or permanent second hand used storage container with a maximum amount of $4,000 to be spent.

On a motion by Councilman McCrary, 2nd by Councilwoman Constable and carried The Board moved to open the public hearing for proposed law #5 0f 2016 entitled, “Amendment to Local Law #1 of 2000 known as Amendment to Alarm Devices and Systems Law (Chapter 42 of the Town Code of The Town of Jewett)” at 8:24 pm.

On a motion by Councilman McCrary, 2nd by Councilwoman Constable and carried, Local Law #5 of 2016 was adopted. This law is entitled, “Amendment to Local Law #1 of 2000 known as Amendment to Alarm Devices and Systems Law (Chapter 42 of the Town Code of the Town of Jewett)”
Be it enacted by the Town Board of the Town of Jewett as follows:
Section 1. Title
This law shall be entitled “An Amendment To Local Law #1 Of 2000 Known As Amendment To Alarm Devices And Systems Law (Chapter 42 Of The Town Code Of The Town Of Jewett)”.
Section 2. Amendment
Chapter 42, Section 42-4 of the Town Code of the Town of Jewett shall be and hereby is amended to read as follows: “The owner and/or lessee of real property to which an emergency agency responds as a result of a false alarm shall be a fee for each such response as set forth in a resolution by the Town Board of the Town of Jewett.”
Section 3. Severability
If any section or provision of this local law or the application thereof to any persons is adjudged invalid, the adjudication shall not affect other sections, clauses or provisions or the application thereof which shall be sustained or given effect without the invalid section, clause or provision or application, and to this end the various sections, clauses or provisions of this local law are declared to be severable.
Section 4. Effective Date
This local law shall become effective upon adoption.

“WHEREAS, The Zoning Board of Appeals for the Town of Jewett has an alternate member that is looking to retire and,
Whereas, the zoning board would like to have an alternate member that can vote in case a regular member cannot and,
Whereas, the secretary to the zoning board Maya Carl is already present during the meetings,
Therefore be it resolved, that the Town Board of Jewett appoints Maya Carl, secretary to the zoning board of appeals to function as an alternate member when required.”

The regular meeting of the Jewett Town Board was held on Wednesday October 12, 2016.
Supervisor Pellitteri called the meeting to order at 7:02 P.M. Present were Board Members Allison Constable, Michael McCrary, Nathan Miles and William Trach. Public present was Werner Pscherer.

Minutes of the September 14, 2016 meeting were accepted on a motion by Councilman McCrary, 2nd by Councilman Miles and carried.
On a motion by Councilman McCrary, 2nd by Councilwoman Constable and carried The Board moved to accept the Code Enforcement Officers report.
On a motion by Councilman McCrary, 2nd by Councilwoman Constable and carried The Board adopted Resolution #32 of 2016. SUBJECT: APPOINTING THE POSITION OF A ZONING ENFORCEMENT OFFICER.
“WHEREAS, The Town of Jewett is looking to hire a zoning enforcement officer and,
WHEREAS, Stacy Sprauge, who is experienced in being a Zoning Enforcement Officer has expressed interest in the position and has come for an interview,
THEREFORE BE IT RESOLVED, The Town of Jewett Board moves to appoint Stacy Sprauge to the position of Zoning Enforcement Officer effective this month.”

Discussions were had regarding Bellstock. Supervisor Pellitteri sent an e-mail to Mr. Bell informing him of the complaints made against Bellstock this year. Mr. Greg Bell responded by apologizing for the complaints and gave assurance that complaints will never happen again. He also told the board that he is willing to meet with them to discuss this in person.
Highway Superintendent’s Report as Follows: Getting ready for the winter season. Getting plows and sanders on, snow fence is up.
The Board reviewed proposed law #5 of 2016. This law is a change in the fee schedule entitled “Amendment to local law #1 of 2000 known as Amendment to Alarm Devices and Systems Law (Chapter 42 of the Town Code of the Town of Jewett. A public hearing will be scheduled for the next general board meeting on November 9, 2016 at 7:00pm regarding proposed law #5 of 2016.
On a motion by Councilman McCrary, 2nd by Councilman Miles and carried The Board adopted Resolution #33 of 2016. SUBJECT: SET FEE SCHEDULES FOR FALSE ALARMS.
“WHEREAS, the Town Board of the Town of Jewett enacted Local Law #1 of 2000 entitled “ALARM DEVICES AND SYSTEMS LAW LOCAL LAW” on October 13, 2000 which included a section setting the levels for the payment of fees for each false alarm to which an emergency agency responded, and
WHEREAS, the Town Board of the Town Jewett believes it is in the best interest of the residents of the Town that such fees should be set by the Town Board from time to time as it deems in its’ sound discretion to be appropriate; and
WHEREAS, such Local Law #1 of 2000 has been amended to reflect such setting of fees by resolution.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of Jewett hereby sets the fees for each false alarm to which an emergency agency responded during any two-year period (chronological, not calendar) as follows:
FIRST FALSE ALARM: $0
SECOND FALSE ALARM: $150
THIRD FALSE ALARM AND EACH SUBSEQUENT FALSE ALARM: $1,000

RESOLVED, that the within Resolution shall take effect immediately.

The Board discussed getting internet access from Mid Hudson Cablevision to Barnum Rd.
Councilman Miles brought up another resident on Natty Bumpos Path that is also looking to get internet access there as well. Attorney Tal Rappleyea will request Mid- Hudson send us a franchise agreement.
Supervisor Pellitteri and the Board discussed and reviewed the preliminary budget. Two more public hearings will be scheduled for the next general meeting on Wednesday November 9, 2016 at 7:00pm. One for the public hearing for Local Law #4 of 2016 entitled, “To Override the Tax Levy Limit Established in General Municipal Law §3-C”. The other public hearing will be for The Preliminary Budget.

The regular meeting of the Jewett Town Board was held on Wednesday September 14, 2016.
Supervisor Pellitteri called the meeting to order at 7:05 P.M. Present were Board Members Michael McCrary, Nathan Miles and William Trach. Absent was Councilwomen Constable.
Also present was Town Attorney Tal Rappleyea and the Town Clerk.
The Supervisor’s financial report was given to the Board prior to the meeting and the bank statements were reviewed by Board Members after the signing of the bills.
A moment of silence was observed for all the victims of 911.
Minutes of the August 10, 2016 meeting were accepted as amended on a motion by Councilman McCrary, 2nd by Councilman Miles and carried.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried The Board moved to accept the Code Enforcement Officers report.
Discussions were made regarding a Zoning Enforcement Officer. Possible candidates will be contacted.
Discussions were continued regarding Bellstock. Supervisor Pellitteri will draft an e-mail to send to Greg Bell regarding complaints that were made after this year’s Bellstock event.
Highway Superintendent’s Report as Follows: Cleaning ditches and cutting shoulders all month, maintaining the highways. Salt Barn is full and ready for winter season.
The Scenic Byway Resolution was brought to the table. Councilman McCrary passed out a copy of an e-mail correspondence he had with the head of the Scenic Byway Committee, Peter Manning.
Mr. Manning gave more of an in depth explanation as to what their purpose is and assured the municipality that in no way would this agency have any overarching authority or impediment to local home rule. He stated that if we were worried about this, we could include a WHEREAS into the resolution that would state, “In no way does any part of this corridor management plan, the Catskill Mountains Scenic Byway, or the Central Catskills Collaborative, impede, limit, or supersede a local municipalities home rule authority (the ability to adopt its own local laws under NYS Municipal Home Rule Law)” (pg. 108).
Councilman Miles then took the floor and stated that he still felt uneasy about this resolution. He proposed to have a public hearing, allowing the people to voice their opinions and concerns.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried The Board adopted Resolution #31 of 2016. SUBJECT: Supporting the extension of the Mountain Cloves Scenic Byway into the Town of Jewett.
WHEREAS, the Mountain Cloves Scenic Byway (MCSB) in the Town of Hunter, a 41-mile state designated byway, was approved and signed into law by Governor Cuomo in 2013, and
WHEREAS, the Corridor Management Plan (CMP) for the MCSB identifies the intrinsic values that comprise the special designation and lists recommendations to protect and enhance the historic, scenic, recreational, and cultural resources along the MCSB, and
WHEREAS, the CMP recommends a regional byway system connecting to neighboring scenic byways namely the Catskill Mountain Scenic Byway along Routes 28 and 214 and 42 to the Greene County line; and
WHEREAS, the Town of Jewett has expressed interest in extending the MCSB through the town in an effort to promote regional byway tourism and offer a connection to the CMSB to the south along Route 42 in Lexington; and
WHEREAS, the NYS Department of Transportation is encouraging collaborations among scenic byways and feels extending the MCSB to connect to the CMSB would enhance both designated byways and include Deep Notch, an extraordinary scenic mountain pass on Rte. 42 that divides two Catskill peaks; and
WHEREAS, the Town of Jewett has many intrinsic resources that complement the MCSB and CMSB and is interested in ensuring that these resources are properly managed and maintained for future generations; and
WHEREAS, in no way does any part of this corridor management plan, the Catskill Mountains Scenic Byway, or the Central Catskills Collaborative, impede, limit, or supersede a local municipality’s home rule authority (the ability to adopt its own local laws under NYS Municipal Home Rule Law) (p. 108)
NOW, THEREFORE/, BE IT RESOLVED, that the Town of Jewett supports extending the Mountain Cloves Scenic Byway through the town on State Route 23A, and other roads in the town worthy of designation, and will appoint two people and/or a small committee to assist in the inventorying of intrinsic resources and serve as advisors to a consultant who will develop a corridor management plan that will be appended to the MCSB CMP; and
BE IT FURTHER RESOLVED, that the Town of Jewett will work in partnership with the Mountain Cloves Scenic Byway, Inc., the Town of Hunter and its incorporated Villages, and the Town of Lexington, in order to support future Byway program development and collaborate with these interested entities to explore opportunities for cooperation and methods to advance the Scenic Byway;
ROLL CALL VOTE: AYE Pellitteri, McCrary and Trach. Councilman Miles abstained from the vote.
Absent was Councilwoman Constable.
George Hewett of Barnum Rd. in Jewett took the floor to ask the Town for help in getting internet access to his property. He relayed how he had reached out to Time Warner Cable and they told him in order to get the wires to his land, he would have to pay around $30,000. He went and asked his neighbors if they would be interested in internet access to help cut down the cost of the initial wiring.
Councilman McCrary gave him a contact number to call at Mid Hudson and told him to reach out to this gentleman as he has worked with the town before. Mr. Hewett also reached out to Mid Hudson Cable, who told him that they cannot cross town lines, due to another company having a franchise agreement with the Town of Jewett. Supervisor Pellitteri told Mr. Hewett to tell Mid-Hudson to call the Town, so that we can enter into a franchise agreement with them. Mr. Hewett agreed to follow thru on those two calls.
Other Business: It was brought to the Towns attention, by the Jewett Fire Company that alarms have been going off on a property that has had issues with the alarm system in the past. The owner has a history of not checking his systems properly. Supervisor Pellitteri will reach out to this homeowner and let them know of the present violations.
Councilman McCrary made a motion, 2nd by Councilman Trach and carried to approve the bills. General Fund was $6,505.19 on abstract #9, claim numbers 173-189. The Highway Fund was $9,447.94 on abstract #9, claim numbers 121-133.

The regular meeting of the Jewett Town Board was held on Wednesday August 10, 2016.
Supervisor Pellitteri called the meeting to order at 7:00 P.M. Present were Board Members Michael McCrary, Nathan Miles and Allyson Constable. Absent was Councilman William Trach.

Minutes of the July 13, 2016 meeting were accepted on a motion by Councilman McCrary, 2nd by Councilwoman Constable and carried.
On a motion by Councilman McCrary, 2nd by Councilman Miles and carried The Board moved to accept the Code Enforcement Officers report.
Highway Superintendent’s Report as Follows: Superintendent Mallory shared with the board that the highway crew has been doing routine work around town, repairing shoulders and driveway areas as well as doing a second cutting. The salt barn is being stocked slowly with sand for the upcoming winter season.
Councilman McCrary made a motion, 2nd by Councilwoman Constable and carried to accept Marianne Romito’s request of leave of absence thru the end of December, 2016.
On a motion by Councilman McCrary, 2nd by Councilman Miles and carried The Board moved to inform Greg Bell of Bellstock, that there were complaints regarding general noise and music around 1am, past the time designated and the release of fireworks which are in violation of NYS penal law 405.
On a motion by Councilman McCrary, 2nd by Councilwoman Constable and carried, The Board moved to re-affirm that The Town of Jewett is not interested in possessing the Rosentreter property.
Discussions were had regarding resolution #31, which was brought to the table by Councilman McCrary. This resolution is entitled, “Supporting the extension of the Mountains Clove Scenic Byway”. By passing this resolution, The Town of Jewett would declare the stretch of road on State Route 23A, between the towns of Hunter and Lexington, to be designated as a scenic byway. Councilman Miles wanted to know more information about what exactly this would entail and questioned if the Town would be unknowingly giving away control to this agency that would trump property owners rights on State Route 23A. Councilman Miles was worried that this agency would begin to dictate to property owners what they can and can’t do on their own property just because the road has been declared a scenic byway. Councilman Miles did not want to vote on this agenda item until Tal Rappleyea, Attorney for the Town of Jewett was present at the meeting and could look over the resolution to answer questions.
Once Attorney Rappleyea arrived, he looked over the resolution and said that the agency could possibly limit property owner’s rights in the future. Councilman McCrary did not think this was an issue and concentrated more on what The Town of Jewett would stand to benefit from this. One thing being grants, another is the advertising of our town on the Scenic Byway website and all the businesses on Route 23A in Jewett would be mentioned. Councilman McCrary said he felt that the inclusion of the scenic byway in Jewett may bring more people into our area. Councilman Miles asked if he could have more time to read over the documents of the Scenic Byway and discuss this again at next moths meeting. Councilman McCrary moved to table the Byway Consideration Resolution until the next general board meeting, which will be held on September 14, 2016.
The board continued discussions regarding code review.

The regular meeting of the Jewett Town Board was held on Wednesday July 13, 2016. Deputy Supervisor Michael McCrary called the meeting to order at 7:01 P.M. Present were Board Members William Trach and Allyson Constable. Absent were Supervisor Pellitteri and Councilman Nathan Miles. Also present was the Town Attorney, Tal Rappleyea and The Town Clerk.
The Supervisor’s financial report was given to the Board prior to the meeting and the bank statements were reviewed by Board Members after the signing of the bills.
Minutes of the June 8, 2016 meeting were accepted on a motion by Councilman Trach, 2nd by Councilwoman Constable and carried.
On a motion by Councilwoman Constable, 2nd by Councilman Trach and carried The Board moved to accept the Code Enforcement Officers report, provided that the Code Enforcement Officer add a small memo each month to show how many building permits had been closed during the report period.
Highway Superintendent’s Report as Follows: Superintendent Mallory told the board how he was approached by homeowners on Beecher Road, requesting to turn over the Road to the Town. Superintendent Mallory said, that if the present road is brought up to specs, it could be taken over by the town.
Accordingly Councilwoman Constable made a motion, 2nd by Councilman Trach and carried:
WHEREAS, a request has been made by the property owner to upgrade Beecher Rd. to the standard needed to turn over said road to the Town of Jewett.
THEREFORE, The Superintendent of Highways is authorized and requested to
liaison with the responsible engineers to accomplish this purpose.
On a motion by Councilman Trach, 2nd by Councilwoman Constable and carried The Board adopted Resolution #30 of 2016. SUBJECT: SUPPORTING PARTICIPATION IN THE NEW YORK CITY- FUNDED FLOOD BUYOUT PROGRAM.
“WHEREAS, it is our intention of the Town of Jewett initiate an LFA and,
WHEREAS, in August 2011, the Town of Jewett, and Greene County, experienced widespread catastrophic flooding from Hurricane Irene, adversely affecting public and private infrastructure, homes and businesses, warranting the declaration of a countywide “State of Emergency,” and
WHEREAS, the Town of Jewett’s Annex to the Greene County Multi-Jurisdictional All Hazard Mitigation Plan identifies supporting the purchase, relocation or retrofitting of structures located in hazard-prone areas to protect structures and public infrastructure from future damages and to ensure Greene County eligibility for State and Federal Hazard Mitigation monies; and
WHEREAS, the Town of Jewett agreed to support eligible landowners to participate in the Hurricane Irene Flood Buyout Program funded by the NYS Emergency Management Office and FEMA Hazard Mitigation Grant Program administered by Greene County Soil and Water Conservation District in conjunction with Greene County Economic Development, Tourism and Planning; and
WHEREAS, at the request of local watershed communities, funding for a voluntary New York City-Funded Flood Buyout Program (NYCFBO Program) has been made available pursuant to the Mid‐Term Revisions to the 2007 FAD (2014) requiring New York City Department of Environmental Protection (DEP) to commit $15 Million to the NYCFBO Program to be implemented in accordance with the conditions of the 2010 Water Supply Permit, as amended. In accordance with the FAD, after extensive negotiations and outreach, Watershed Stakeholders have agreed upon a process for property evaluation and selection, as documented in “NYC-Funded Flood Buyout Program Property Evaluation and Selection Process” dated June 1, 2016 (Process Document), which relies on a further amendment of the 2010 WSP to allow DEP to implement the NYCFBO Program in communities that elect to participate in the Program (“Communities”); and
WHEREAS, the stakeholders have identified five distinct categories of properties, as set forth in the Process Document, that may be eligible for acquisition under the NYC‐funded FBO; and
WHEREAS, the Town of Jewett wishes to opt in to the Erosion Hazard category (Category 4) supporting eligible properties with structures located very near the edge of an eroding bank or failing slope that are in imminent threat of failing or likely to fail within a short time horizon as identified by a slope stability analysis by a qualified engineer; and
WHEREAS, the Town of Jewett will have candidate properties evaluated for substantial and imminent risk to life and property, as identified in the Process Document; and
WHEREAS, the NYCFBO Program will not acquire properties unless the proposed acquisition is agreed to by the Town of Jewett based on the specific procedure(s) used to confirm such municipal concurrence as noted in the Process Document; and
WHEREAS, the Town of Jewett chooses the Greene County Soil and Water to serve as the Town’s Outreach Lead and will enter into an Agreement with Greene County Soil and Water to facilitate the NYCFBO which will include for each category of flood buyout above a defined process of identifying candidate properties, ensuring support by critical stakeholders, evaluating the extent of the hazard and eligibility of the property, and selecting the highest priority properties for acquisition.
NOW, THEREFORE BE IT RESOLVED THAT:
The Town of Jewett wishes to opt into the NYCFBO Program Category 4 Erosion Hazard and work through the Greene County Soil and Water (outreach lead entity) to facilitate potentially eligible properties in this category as outlined in the Process Document.

The regular meeting of the Jewett Town Board was held on Wednesday June 8, 2016. Supervisor James Pellitteri called the meeting to order at 7:04 P.M. Present were Board Members Michael McCrary William Trach, Nathan Miles and Allyson Constable. Also present was the Town Clerk.
The Supervisor’s financial report was given to the Board prior to the meeting and the bank statements were reviewed by Board Members after the signing of the bills.

Representative from Mountain Jam/Taste of Country, Bruce Transue, took the floor to give the board all the paperwork that the town has requested from them for this event. All paperwork was in order. A permit will be given to Mountain Jam and Taste of Country provided that the noise ordinance law is posted on premise and that they receive their insurance certificate. Mr. Transue will contact the town as soon as they receive the insurance certificate.

The Tour of the Catskills has changed the date of their event, which will now be on the same day as Mountain Jam. The Board is concerned because there will be many people in the area already. The regular meeting of the Jewett Town Board was held on Wednesday March 9, 2016. Supervisor James Pellitteri called the meeting to order at 7:00P.M. Present were Board Members Michael McCrary, Nathan Miles and William Trach. Absent was Councilwoman Allyson Constable. Also present was Town Attorney Tal G Rappleyea and the Town Clerk. Public present were Janet Nicholls and Bruce Transue.

Highway Superintendent’s Report as Follows: The Highway department has been able to save a lot of money this winter season. We did not have too much to plow or sand and in turn that has allowed us to save on fuel, salt/sand and overtime. We have been able to get a head start on spring work because of the mild weather and have started doing some shoulder work, cutting trees/ brush, as well as washing down all our trucks.
We will be getting ready to broom soon; the long range forecast is looking at 50 degrees. There have been a few inquiries about town road takeovers.
Bruce Transue took the floor to talk about Hunter Mountains’ upcoming plans for Taste of Country & Mountain Jam. They will begin to start the process of applying for various permits and will get all the necessary paper work to the Town of Jewett as soon as possible.
Town Historian, Janet Nicholls took the floor to give her annual Town Historians report. She shared with the board what she had worked on in 2015 and what she is currently working on now.
Ms. Nicholls was thanked for her report and the work she has done.
Ms. Nicholls also spoke regarding her concerns about speeders and the intersection of Route 296 and Route 23C. She would like the Town to write a letter to the NY State Police asking them to place more police cars along route 296 to monitor speeds. Supervisor Pellitteri agreed to look into this.
The Town Board tabled the Code Enforcement Officers Report to the next general meeting on
April 13, 2016, pending clarification of the list of Open Building Permits.
On a motion by Councilman McCrary, 2nd by Councilman Trach and carried The Board adopted Resolution #14 of 2016. SUBJECT: Waiving of Building and Zoning Permit Fees Due to Hardship
“WHEREAS, mitigating circumstances have brought destruction from a fire to parcel # 129.00-2-11 and,
WHEREAS, there are mitigating circumstances regarding an elderly mother,
THEREFORE BE IT RESOLVED, in this particular situation, The Town of Jewett will choose to waive the building permit fee and zoning application fee for parcel # 129.00-2-11”.

The 10th Annual Schoharie Watershed Summit will be taking place on April 2, 2016.

Highway Superintendent’s Report as follows: Superintendent Mallory has been pricing numbers for our road signs, to replace the yellow with white as NYS has mandated and will be approx. $2500. Supervisor Mallory also looked into the quality of aluminum signs for the Welcome to Jewett signs and it was not a good quality. The Superintendent recommends the board go with ply-wood instead which although more expensive will last longer.

Highway Superintendent’s Report as Follows: Plowing has been at a minimal and not much money has been spent towards salt and sand. Superintendent Mallory received a letter from the NYS Department of Transportation regarding a shared service agreement for emergency assistance.

Permission is given to the Supervisor to pay electric, health insurance, telephone and discounted bills when they come due. A running balance of $100.00 for the Town Clerk/Tax Collector from A1410.4 will be maintained. Permission is given to the Supervisor to enter into an Inter-Municipal Highway Agreement with Towns and Greene County. The Deputy Registrar of Vital Statistics, Cindy Mallory will be paid $50.00 per year from A4020.4. The Deputy Tax Collector and Records Retention Officer receives no compensation. The Town Board authorizes expenditure of funds for job-related schooling.
Board meetings are the second Wednesday of each month at 7:00 P.M. in the Municipal Building. Audit by all board members will precede the regular meeting at 6:45 P.M.
Mileage reimbursement is $.45 per mile for all Town business not occurring at the Municipal Building.
Committee and liaison appointments, if any, will be made at the February meeting.

Also present was Town Attorney Tal G Rappleyea, Mike Ryan newspaper reporter and the Town Clerk. Public present was Brett Hogan.
Minutes of the November 11, 2015 general meeting were accepted on a motion by Councilman McCrary, 2nd by Councilwoman Constable and carried.
Highway Superintendent’s Report as Follows: We have been cleaning some ditches and working on organizing the shop. They finished painting the last of the plows and restored the 1 ton truck. Supervisor Pellitteri would like the highway department to restrict access to vehicles entering the cemetery during the winter season, with an area open for walking to gravesites. Superintendent Mallory will look into possibly building a walk-in gate.
Brett Hogan took the floor to speak to the board regarding fines he received due to multiple alarms going off on his property between 8-1-2013 thru 8-25-2015. Mr. Hogan told The Board that he has addressed the problem by installing off buttons and moving the fire alarms farther away from each other. He assured the board that this will not happen again. He is also trying to reach out to the Jewett Fire Department. Mr. Hogan is asking the board to forgive/ reduce his fines. Supervisor Pellitteri explained to him that The Town had already forgiven him the prior year’s violations and that we would have held the extra $500 for the last violation in abeyance, if the fine was paid in a timely manner and that there were no further violations. Supervisor Pellitteri also said that if Mr. Hogan would have responded with our first notice in August and fixed the problem, his total cost would have been $675. The Board denied his request due to him being non-responsive for many months regarding the matter and Mr. Hogan paid his fine in full.
Discussions were continued to be made regarding The Countywide Ambulance proposal.
Councilman McCrary made a motion, 2nd by Councilwoman Constable and carried to renew the present lease contract with the Department of Human Services under the terms proposed.
On a motion by Councilman McCrary, 2nd by Councilman Miles the board carried to table the re-appointments to the planning and zoning boards at the year-end meeting.
The date for the year end meeting has been set for December 28, 2015 at 6PM at the Town of Jewett Municipal Hall.
